What if I cannot apply for PR?

This post is for people who are interested in studying in Australia, are currently studying in Australia or about to finish their degrees from an Australian University.
Now that you have finished your degree, you would be interested in getting some valuable Australian work experience by working in your related field of profession.


Most students who have planned their stay and studies well would be able to apply for Permanent Residency which gives them lots of room for applying for jobs relevant to their fields.

But if you are one of those unlucky ones who didn't plan their stay and now find themselves in a situation where you cannot apply for Permanent residency, and you also want to get some work experience in your own field before you return back to your home country, then here are a few tips and tricks for you.

1. First of all, dont lose heart if you cannot fetch enough points of PR. There are lots of other visa schemes which can help you out like state sponsored nominated and employer sponsored etc. Talk to a lawyer and may be he can tell you of a way out.

2. If you have no other options, then you can always apply for a Graduate skilled visa.

Skilled – Graduate (Temporary) visa (subclass 485)
An 18 month temporary visa for overseas students who have obtained an Australian qualification in Australia as a result of at least two (2) years study. Allows applicants who are unable to pass the points test to remain in Australia for 18 months to gain the skills and experience needed to apply for a permanent or provisional General Skilled Migration visa. No points test applies.

The 485 temporary graduate skilled visa is only being offered to students who are eligible for transitional arrangements.

Transitional arrangements for students and former student visa holders were announced on 8 February 2010, the day on which the Australian Government announced a number of skilled migration reforms. These transitional arrangements are in place until 31 December 2012.
You are eligible for transitional arrangements in relation to points tested skilled migration if:
  • on 8 February 2010 you held a Skilled - Graduate (Subclass 485) visa
    or
  • on or before 8 February 2010 you made a valid application for a Skilled - Graduate (Subclass 485) visa and the visa application has not been finally determined
So if you are not part of the transitional arrangements then you will not be able to apply for the graduate skilled visa.

Please note that you can only apply for the graduate skilled visa if and only if you have studied for two years in Australia. Please make sure you understand what the two years rule means. I have explained that in another post. Visit the link to get and understanding of it.

So this 18 months graduate skilled visa gives you the option of staying and working in Australia. Now its up to you to get a job and get work experience in your own field.

You might also be able to claim extra bonus points based on your work experience and actually be able to apply for permanent residency later on.

That depends upon two things

1) Skill set, expertise and work experience of the person

2) Full time work rights

And what about PR then?

You can apply for PR IF you can get a positive skills assessment in a profession on the SOL or CSOL and you are invited to apply for an application after your EOI is accepted.

If can not obtain PR for a person who has MBA in HRM in melbourne, is there any option to have it in any state in aussie?

That depends whether you can get a positive skills assessment in a profession which is on demand list of a State or territory.

For state nomination there are quite a few things required.

It depends whether you will be able to gain a positive skills assessment in a profession on CSOL after completing your one year degree/diploma in IT or accounting.

So check what profession you plan to apply for after completing your one yr diploma/degree and whether it is on CSOL or not.

There is no such thing as PR subjects.

There is a list of professions which are listed on SOL and if you study in a subject that is CLOSELY related to the profession on SOL then you can get points towards applying for PR.




I have heard that people have applied after completion of masters programme in hospitality but I didn't find it ( this subject) on the website.

Is your course a CRICOS certified course?

If your course is not on the CRICOS website then you do not fulfill the two yr study requirement.

Yes you do fulfill the 2 yrs requirement as long as the degree is registered as a 2yr degree with CRICOS and you finish the degree in not less than 16 calendar months.

o To meet this requirement, you must have completed in no less than 16 calendar months either:

a single qualification requiring at least two academic years study
or
more than one qualification resulting in a total period of at least two academic years study.

The two academic years study must contribute towards the award of an acceptable qualification that is closely related to the occupation you nominate on your General Skilled Migration application. Check the registration of your course(s) on Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS) website.

The 92 weeks of study could contribute towards the award of one or more acceptable qualification. In this instance, the courses of study need not have been undertaken within a 24 month period. It is possible to have a break between completing the first course and commencing the second.

The department will use CRICOS to determine the standard duration of a course. A course that has a registered duration of 92 weeks is considered to meet the two academic years requirement.
What is meant by two academic years study?

Two academic years study is defined as 92 weeks of registered study.

It is a measure of the amount of study you have completed rather than how long it took you to complete the study. The requirement that you complete two academic years study does not mean that you need to study full-time to meet the Australian study requirement.

You can take longer to complete those requirements if you so choose. That is, if you take 92 weeks to complete a course registered with CRICOS for only 78 weeks, that course will still only count for 78 weeks towards meeting the Australian study requirement.

There is no upper limit on how long you can take to meet the Australian study requirement. It is a measure of the amount of study you have completed rather than how long it took you to complete the study. �Only study successfully completed counts towards the two academic years.


Will i immediately be able to file TR?

You need to have fulfilled the criteria for applying for TR which is a 2 to 4 yr temporary graduate skilled visa subclass 485.

Requirements

You might be eligible to apply for this visa if you:

are younger than 50 years of age
are in Australia
hold an eligible visa
meet the two-year Australian study requirement
have at least competent English
have recently graduated with either an eligible qualification or with skills and qualifications that relate to an occupation on the skilled occupation list (SOL).

I will be flying to Melbourne to study for two year. I have 65 points towards PR and have had my application evaluated by a MARA agent Who agreed that I was eligible for a PR. However I have already obtained my student visa. Since student visa is a temporary visa and since i am eligible for OR and have enough points to apply Can I apply for a PR once I land in Melbourne and convert myself to a local student from an international studen?

I am not sure what you mean by best course for PR.

There is no best course for PR. However there are professions listed on Skilled Occupation List (SOL) which you can nominate and if you can provide evidence that you are skilled in one of those professions then yes you can apply for PR based on your skills in a particular profession.

The only thing you can do from a course perspective is to study for 2 yrs in a course closely related to the profession you plan to nominate and that will get you 5 points.


So what is the profession you are planning to nominate on the SOL?

My condition is, i was working at SME's in Indonesia, so i think it won't valid to gain the point from work experience for PR.

That depends what your work experience is in? Is it in some thing that is on the SOL like engineering? medicine etc?

Yes Chef is listed in the list however I cannot tell what is needed to prove to the department that you are a qualified chef.

Yes you can study for 2 yrs and then apply for 485 visa but that depends on whether the profession of Chef will be on SOL by the time you finish your studies.

For 457 and RSMS you will need to convince an employer to sponsor you. There is no guarantee that an employer will sponsor you simply on the basis of your degree in cookery.

Again, you need to see if accounting is on SOL and whether you can get a skill assessment in accounting from the assessing body.

Best is to get work experience in profession while you are in your country as making end meets in Australia becomes very difficult.

Yes you can apply for PR while you are on a student visa.

Your visa application can take up from 6 months to 24 months to process so meanwhile you will still be an international student.

My student visa expires this 5th August, 2015 and i am now stuck not knowing what to do. Most of my friends have been telling me that if i get 60 points, I am eligible to apply for PR. Although, i feel it is not possible because i do not have job experience here in australia. I have got IELTS 7.5 with all band scores no less than 7. I've got a Bachelors degree from india as well.
your advise on this will be really appreciated.

No, you cannot apply directly for PR after completing two yr study. You will have to first lodge an EOI and if your EOI is accepted then yes you can lodge a PR.

You also need to ensure that what ever you study is closely associated with a profession on SOL or CSOL.

You can lodge an application for a 18 month graduate skilled visa before your student visa expires. Read up more on the graduate skilled visa here.

If you have 60 points then you can lodge an EOI and wait for an invitation.

You need to do the following

1. First of all see what profession on the SOL can you gain a positive skills assessment in?

2. If there is a profession that you can get a positive skill assessment in then you should start planning for lodging a EOI. Get all the documents ready for EOI.

3. If you are invited to apply for a visa then you lodge an application for a visa.

4. Please also ensure that at the end of your student visa you are able to apply for another visa like graduate skilled visa etc so you can stay legally in Australia.
