The Two year rule

PLEASE NOTE THAT AS OF 23RD MARCH, 2013, International students can no longer directly apply for PR after studying for two years.

The two year rule is still valid in many situations. However, International students should not be tricked into believing that they can get PR just by studying for two years in a degree which is closely related to a profession on the SOL.

What is the two year rule?

Its very important to understand the two year rule.


The two year study requirement was introduced in July 2003 in recognition of the value of Australian study in equipping visa holders to find skilled employment and settle easily in Australia. The intention of the two year study has always been to ensure that applicants for GSM have a strong foundation of at least two academic years study in Australia. The value arises not only from having an Australian qualification but from having substantial exposure to Australian society and culture.


The Government has amended the Regulations to clarify the two year study requirement in response to some confusion surrounding its interpretation.

From 1 September 2007, to meet the two year study requirement, applicants will have to complete one or more degrees, diplomas or trade qualifications for award by an Australian educational institute as a result of a course or courses:

  1. Registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS);

  2. Completed as a result of at least two academic years’ study;

  3. Completed in a total of no less than 16 calendar months; and

  4. That the applicant studied in Australia, while holding a visa that allowed study and for which all instruction was conducted in English.

In addition:


  1. Students will not be penalised for changing education providers provided they obtain credit for their previous study and this study was in a CRICOS registered course undertaken in an Australian institute while physically present in Australia and in accordance with any visa conditions.

  2. In line with the National Code 2007, students will also be able to count study undertaken online towards meeting the two year study requirement (up to 25%), if they were in Australia for the duration of that period of study.

These changes benefit students because they allow more flexibility.

What is two academic years?



To demonstrate that you have studied for at least two academic years, you must show that you have completed the equivalent of two years study at 100% of a full-time load. If you are given credit from prior learning it will reduce the amount of study you have completed.


The department will use CRICOS to determine whether a course meets the two year requirement. From 22 October 2007 a course that has a registered duration of 92 weeks will be accepted as a course equating to two academic years of study.

Examples:

  1. If a student completes a full qualification in a course that is registered as 92 weeks, they will have met the two year study requirement.

  2. Where a student completes two eligible qualifications, each related to their nominated occupation, that together total at least 92 weeks registration on CRICOS, they will have met the two year study requirement.

  3. Where a student enrols in a three year full time course, they can be granted recognition of prior learning or credit for up to one year of full-time study and still meet the two year study requirement (as defined above) when they complete the qualification.

  4. Where a course is CRICOS registered for 92 weeks a student enrolled in this course who is given any credit for prior learning will not have completed two academic years of study. In this situation, the applicant would need to have (or complete) an additional eligible qualification related to their nominated occupation in order to have completed, in total, the required two years of academic study.

  5. If a course is CRICOS registered for 92 weeks but a student elects to complete the course through accelerated learning, for example through a summer semester of study, the student is considered to have met the two year study requirement if they complete the course in no less than 16 calendar months.

  6. If a student enrols in a course that would only require 1.5 years to complete full-time but has taken two years to complete, this will not have met the requirement for two years of academic study.

Example 1:
If a course is CRICOS registered for 138 weeks (3 years) and consists of 24 units, 100% of full-time enrolment would equate to 8 units per year. In that course, a student will have completed two academic years when they have successfully completed 16 units. That means a student enrolled in that course can be given credit for prior learning for up to 8 units and still complete two academic years study.

Example 2:
If a course is CRICOS registered for 92 weeks (2 years) and consists of 12 units, 100% of full-time enrolment would equate to 6 units per year. Students would be required to complete all 12 units to meet the two year study requirement.

A student enrolled in this course who is given any credit for prior learning will not have completed two academic years study and may have to complete an additional degree, diploma or trade qualification to meet the two year study requirement.

My case:

I will explain my own example to make things easy for understanding.
You can see the certificate of completion from my university below.





Certificate of completion issued to me by UTS at the end of successfull completion of my degree.



As you can see the certificate shows two things
  1. The start date and the end date, which is from 28th of Feb, 2005 to 18th of July, 2007. A total of 29 months OR 116 weeks.
  2. The other important thing mentioned is the "Normal full time duration" of the course which is 4 semester (2 yrs or 52 weeks).
Although I completed the course in an extra 6 months, the actual duration of the course is 2 yrs, NOT 2.5 yrs.


So when the immigration department opens your case file, it will look at two things


1. The official course duration as listed on the CRICOS website. In my case, my course is 104 weeks.

2. The total duration of the course in a full time load as shown by the certificate of completion on the letter issued to you by your university.


I hope I have cleared the doubts of every one by providing my own example.

My course is only for 1.5 years and that how is it. however its accounting and its registered as 108 weeks not even 92. besides, i have to repeat 2 subjects. so i will end up studying for another 4 semster. do you think i can apply like this for a PR? and there is another option is to enrol in another master degree afterwords then exit after one semster and recive a certificate. will this count for pr? THANKX

I am unable to understand what you are trying to say.

A course cannot be 78 weeks and 92 weeks at the same time.

Please mention your query in understandable English so I can correctly answer you.

Last of all, you have to understand that all your education has to be 92 weeks FULL TIME.

2 subjects per semester is not considered FULL time. You must be enrolled in at least 18 credit hours per semester (normally three subjects) throughout your education in Australia, for being eligible for PR.

Hello, I hope you can enlighten me on this. I'm not sure if I would qualify for the two year rule. I studied in Melbourne from 1998 - 2000 and got an Advanced Diploma of Electronic Design and Interactive Multimedia from the Chisholm Institute of TAFE. I came back to my country afterwards and worked for 3years. Then went to UK and worked for another 3 years. Not all of these 6 years were related to my field. Am I elligible to apply for a Temporary Residence to work in Australia now even if I finished this course in 2000? If so, how do I proceed? What forms do I need to submit?

The two year rule applies to those people who are applying for PR on the basis of having studied in Australia for 2 years as an International student.

One of the several conditions for applying for PR on the basis of being an international student in Australia is that you MUST apply for PR within 6 months of the completion of your degree that is when your result is announced officially by your education provider.

Since it has been almost 8 years since your result was announced, you cannot use your education between 1998-2000 as a basis for having studied in Australia.

However, you can claim points for your Australian education while applying for another migration visa like an offshore migration mentioned on my blog.


***Not all of these 6 years were related to my field.

That can be a potential issue because if you are applying for PR on the basis of being an IT professional, you must have 4 years of experience to get a positive assessment from ACS. So as long as you can justify yourself to ACS and get a positive assessment for migration purposes, you can apply for an offshore migration visa.

Since you have studied in Australia, you can use that to get a positive skill assessment from ACS and use your work experience as well.


***Am I elligible to apply for a Temporary Residence to work in Australia now even if I finished this course in 2000?

Temporary work visas are only given to citizens of certain countries. You can check whether you can get a temporary work visa from the Australian embassy in your country.

Your course which you did in 2000 has nothing to do with temporary work visas. Temporary work visas are a whole different ball game.

As I said, temporary work visas are different from Permanent Residence visas, so I cannot guide you on that.

Its up to the Australian embassy of your country to give you a temporary work visas.

Hello, im quite confused here actually, i was wondering if you could clarify something for me. Im doing a Masters by research, and its registered for 18 months. Im supposed to submit my thesis by the end of these 18 months but naturally the examination process would follow and i will have to extend my student visa for another 6 months in order to wait for the end of the examination. So my studies will add up to 2 years. Besides, Masters by research is different from Masters by coursework in that we dont get any time off in summer or any other holidays except for 4 weeks whenever we want, so during 18 months we actually study just as much as coursework students during 24. And there are no units to be taken or anything, just working on the thesis from the very beginning till the end. So my question is, will i not be eligible to apply for PR? Thanks in advance!

You did a 18 months degree in 24 months, that's your fault. In the eyes of the case officer, it is still a 72 weeks degree, not 92 weeks.

Yeah, that's the time you took to complete the degree. 2 years was not the official time.

You can actually study even on weekends and consider it as a part of the 24 months, but for the immigration department what is important is the official duration of the course as registered with the department of education.

If I am registred for a MBA which is CROCOS registred for 104 weeks and recieved credit for one subject out of twelve, will I be fulfilling the 2 year study rule ?

Yes, you will fulfil the two year requirement as you will still do the course in 104 weeks. Make sure you remain a full time student for duration of your course.

Also please check if your profession is on MODL/SOL or not.

You may be fulfilling the two year requirement but if your profession is not on MODL or SOL then there is no use for applying as you wont get the pass mark unless you get extra points some other way.

No you cannot, because if you read the rules, it says that all time period spent in australia while studying full time must result in a degree or multiple degrees.

You cannot jump to another degree and apply for PR while you are still studying it.

Just completing 2 years of education is not the point. completing the degrees is what matters in 2 years.

What you can do is that instead of doing the complete masters degree, just do the Diploma for one year and then apply for PR.

Please note that before taking my advice you must consult a professional lawyer regarding my last advice, as rules keep on changing.

As long as you fulfil the following criteria

1. The total amount of time studying in Australia equals 2 academic years.

AND

2. Each of your enrolment in a new degree resulted in the completion of that degree/diploma.

You can apply for PR.

hi,

I am currently a master student in accounting and finance which is a 2 year course. i have already completed one year of study at my current university. i plan to change my education provider and be enrolled in a 1.5 years course called master of professional accounting. if i do go to another university, it will take me one year to complete the master in professional accounting. If we count the year i already spent at my current university plus the year i will spend at the other uni, that will add up to 2 years of study. Do u think i will be eligible to apply for the Pr for changing to a 2 years course to 1.5 years at a different university?

I am not sure which university are you at now. An Australian university?


When you graduate from your university and apply for residency, the immigration department will ask for a letter from your university saying that you have completed your degree. That letter will show the amount of time you took to complete your degree.

Since you only have one degree and that degree is officially registered as 1.5 years, you will not be able to fulfil the 2 year requirement.


Although, you have spent two years studying in Australia, ultimately you were awarded a degree which is officially registered as 1.5 years course.

The best way would be to continue the same course you are in, as it is officially a two year degree.

Hello,

I'm very interested in applying for Australian Imigration by choosing study as a pathway! I've recently completed a 4 years bachelors degree in business administration (honours) with HRM as a Major from Bahria University, Islamabad, Pakistan. I've been looking at the make-up of the 120 points needed ultimately to be eligible for immigration and understand most of the rules. However, the 2 year rule is somewhat confusing!

I'm interested in applying for the 2 year Masters of Business Advanced program at the University of Queensland and want to complete that degree with only one majors which is human resource management (by taking advanced level courses in the same major). The same degree is also offered by the Brisbane Graduate School of Management at QUT.

However, I was recently told by someone that with the change in the 2 year rule (September 1st, 2007), applying for such degrees no longer makes me eligible to apply for immigration at a later stage! I've been told that the new regulations demand that I first complete a 1 year diploma course and then go for a 1 year masters degree, and only then will I be able to meet the 2 year study requirement. Is that really the case? Could you please clariy this situation!!!

I've also gone through the requirement of completing 92 weeks of study and I think that a 2 years M.Bus Advanced degree should fulfil that criterion. I'm also pasting the links for degrees that I'm interested in, below.

Both the links you provided take me to a degree which is registered full time as 2 years.

But my dear, the question is, what profession are you going to chose from the SOL or the MODL, which is CLOSELY related to these degrees you are interested in, after completing the degrees in 2 years?

I don't think so there is any profession right now on the SOL or the MODL which is closely related to the degrees you want to do.


Just doing a 2 years degree is not what gets you Permanent residency.

What is also required is that you do a degree which is closely related to a profession on the MODL or the SOL. Which is what the Australian gov is interested in. Because if you do a degree in some thing which is not required in Australia, then whats the use of your studying 2 years.


Please check the MODL and SOL and figure out an occupation in demand which is closely related to the degree you aspire to do. Then go and check the website of the assessing authority which will give you a positive skills assessment for your degree saying "that yes this person has got the skills which are in demand and he is fit for the profession XYZ listed on the MODL or SOL."


MODL = Most on demand list
SOL = Skilled occupation List

When you finish you degree, your university will only issue the statement saying "Eric was enrolled in a 1.5 years degree which he completed in 1 year due to prior exemptions"

When you go to your older university, and ask for a letter of completion, they will not give you a letter of completion since you left them in the middle and didnt complete any degree.

So officially, you completed a degree which is 1.5 yrs. Although you took 2 years to complete it.

Thats what the 2 yrs rule explain.

Ans 1. Yes you can do a diploma of one year by studying full time. Its not necessary you complete a degree which is normally of 1.5 or 2 yrs.

Ans 2: As long as the diploma you are enrolling in is "CLOSELY RELATED" to the earlier degree you did

AND

You study in the diploma full time for one year

AND

You complete the diploma

AND

Your diploma + earlier degree are CLOSELY RELATED to the profession you have chosen on the SOL.

Then you are eligible to apply for PR.

You still have to achieve the pass marks for being granted a residency visa.

Yes these two courses are closely related as your skills for these particular degrees would be assessed by the same body that is ACS and not two different bodies.

Hi.. i plan to study master in australia and want to get the PR. But i still confuse about "The two year rule". I apply in UTS, the length of study is 4 semester, and i can apply for up to 4 subjects recognition prior learning of 16 subjects. And i think i will apply for 2 subjects only. it means, at the end of semester i will study for 3 subjects,( semester 1: 3 subject,semester 2&3: 4 subjects, semester 4: 3 subjects) is it eligible to apply PR?

I am a little unsure about your case.

As the paragraph you yourself quoted says that if you take prior exemption, you will have to take extra courses to make up for the courses you got exemption for.

I would suggest you contact a professional lawyer to discuss your case.

Diploma is normally of one year. You need to have studied for two years in an Australian university while in Australia, to be eligible for applying for PR. Where are you doing your degree from?

You get 25 points for 7 in all bands of IELTS and 30 points for your age. There are lots of others things to consider before I can tell how many points you can get.

Use the points calculator to have an idea of how many points you get.

You should verify that from your university as different universities have different standards.

Ask your university as to what is one unit considered.

If your course is of two years, then you can apply for Permanent residency. Provided you do not take any exemptions.

Courses do not have points. Occupations on SOL and MODL have points.

The course you do should be closely related to profession listed on the SOL or the MODL. Then you can get 60 or 70 points.

So your question should be whether the course you are doing is closely related to MODL or SOL?

If you are not sure about things, I can refer you to a lawyer who can help you out.

As I mentioned earlier and I am repeating again over here. It is not your course which carries points. It is the CLOSELY RELATED Profession related to your degree on SOL/MODL which carries points. So after your degree if you chose profession A, which is closely related with your degree, and is listed on the SOL/MODL, then check how many points that profession has. Most professions on SOL have 60 points and most professions on MODL have 70 points.

But at the end of the day it comes to the course you enlist is as you will be matching your degree with one of the professions on the SOL or MODL.

Plus your degree is also of one and a half year which should be 2 years instead. So you have to enroll in another 6 months to complete the 2 years requirement.

No, as you are enrolled in a 1.5 years degree, you cannot benefit from the temporary graduate skilled visa which is explained below.

However, you might explore other options such as State territory nominated , STNI and TR. I am not fully sure of how it works and it would be good to contact a lawyer for it. Let me know and I can refer you to one.

About this visa

This visa allows overseas students who do not meet the criteria for a permanent General Skilled Migration visa to remain in Australia for 18 months to gain skilled work experience or improve their English language skills.

As a holder of this visa, you may apply for permanent residence at any time if you are able to meet the passmark on the General Skilled Migration points test.
Who is this visa for?

This visa is for you if you are an overseas student who:

* is under 45 years of age
* in the last six (6) months has completed an eligible qualification(s) as a result of at least two (2) years study in Australia
* is unable to meet the passmark on the points test for the Skilled – Independent (Residence) visa
* has the skills and qualifications that meet the Australian standard for an occupation on the Skilled Occupation List (SOL) and your nominated occupation is classified as either a 60 point occupation or a 50 point occupation.

You will not be able to apply for the graduate temporary visa because you have only studied for 18 months.

Hi! I completed a Bachelor of Information Systems and am now working towards a 1.5 year master of professional accounting. As I know that the 2 year rule states that the studies should be closely related to the nominated job. I just wonder if I am able to meet this 2-year study requirement if I nominate accountant as my job, given that my studies are information systems and accounting.

As you have yourself mentioned, that your degree is 1.5 years, hence, you do not fulfil the requirements of applying for an application.

The requirements are

1. You should do a two years degree ,92 weeks

2. Your nominated profession on the SOL/MODL should be closely related to the 2 years degree you have done in Australia.

YES, by studying full time for two years in a course which is closely related to a profession listed on the SOL/MODL, you fulfil the pre-requisite of two years full time study.

However, you still have to score , 120 points to be eligible for Permanent residency.

So to answer your question, YES, you can apply for Permanent residency. Whether you get residency or not depends upon how many points you score.

When I first came here i was enlisted in the Master of Finance prog, but it was not for me so I exited the program after completing the Graduate Certificate stage (i.e after the 1st sem - 6 months, 48 credits)
I am now enrolled in the Master of Commerce specializing in marketing (1.5 yr course,144 credit points)which I complete in Nov 2008.

Will this count as 2 yrs of study or do I have to another 1 year diploma course?
Also I will be getting the 668 visa so need only 100 points. Which I meet with my age, IELTS score and 50 points if I nominate the Marketing Specialist occupation.

my only prob is the 2 yrs study clause. If I do another 1 yr course will i still be able to get pts for the M.Comm degree bcoz I would be awarded the degree more than 6 months before applying for PR.

Yes this counts as two years study.

However, the question is whether your latest degree and your earlier certificate are CLOSELY related to the profession which you will ultimately chose on the SOL?


All your degrees/ trade certificates/ diplomas must be CLOSELY related to the the profession you chose on the SOL/MODL.

1. Check whether the master of finance degree is closely related to the commerce degree or not.

If yes, then simply apply for PR.

If not, then enrol in yet another 6 months trade certificate which is closely related to what you are studying right now and apply on its basis.

That would mean that you did a 1.5 years plus 6 months study.In this case, unfortunately, your earlier 6 months in finance would go waste. So although you did 6 months + 1.5 years + 6 months years study, only the last 1.5 yrs plus 6 months would count.

And yes you have to apply within 6 months of your results being released.

The question remains whether your courses are closely related or not. For that, you have to consult a specialist lawyer as I am unable to answer that question.

Sorry I made a mistake with the visa. It is actually "Skilled – Sponsored (Residence) visa (subclass 886" which I will be applying for.

As i mentioned earlier I am currently studying the M.com degree and have taken 9 subjects in Marketing out of the 12.
Would'nt Finance and Marketing be closely related since both are in the Business field and if someone would want to work as a Marketer in
a bank they would require a bit of Finance background. (just my opinion)

And the Finance course was only a Graduate Certf and not a diploma or degree as I exited at the 1st stage, so not sure if it is recognized for the 2 yrs Rule.

Yes I would be happy if you could recommend a good cert lawyer.
I have found a few online which charge between $200 -$250 for a 1 hr consultation. So contemplating which one to visit b'coz it is no small amount.

For skilled sponsored visa 886, apart from the rest of prerequsites of visa 885, 886 visa also requires that either:

You, your spouse or your interdependent partner have an eligible relative living in Australia who is willing and able to sponsor you

or


You have a nomination from a participating State or Territory government agency.

So I hope you are aware of how you have to get this visa.

What matters is whether you want to have it considered in the 2 years study or not. If no then fine. If yes, then it has to be closely related to the rest of the degrees and as well as the profession on SOL/MODl that you have chosen.

Ideally, this is the information you would get from your asessing body.

No it is impossible to tell how often the professions on the SOL change.

It depends upon the conditions and demand of the market.

It is quite possible that you take admission in accounting and just one month before your lodging the application, accounting is removed from the SOL. That would leave you high and dry in the middle of no where.

Summary:

You will be doing two degrees in 2.5 years.

MEM for one year.
MBA for 1.5 year.

As I can see, the profession which you would chose on the SOL/MODL would be some kind of engineering profession. Right?

Now, after chosing your profession on the SOL/MODL you will have to get a positive skills assessment from the eingeering council of Australia.

The problem is that the engineering council of Australia doesnt consider your post graduate qualifictaions. It considers your undergraduate degree for purposes of skills assessment.

So you will have to apply to engineering council on the basis of your undergraduate degree NOT postgraduate degree.

Check my post regarding that on the blog.

You must be thinking then why the hell did you do the 2.5 yrs of study for? Well that is just for sastisfying the requirements of the immigration department. Yes this sounds stupid but thats how it is!

For engineers it is better to work for one year in their profession and then apply for offshore immigration from thier country.

For IT professionals its difficult as ACS requires 4 years of experience. So to escape four yrs of waiting, we IT professionals do 2 years of study in Australia.

So all depends upon what degree did you do in your under grad and what profession you chose on the SOL/MODl and whether Engineering Australia gives you a positive skills assessment for that profession or not.

Your post graduate degree will only help you a little bit in the assessment but the main thing is the undergraduate degree.

If the engineering council of Australia gives you a positive skills assessment for the two degrees you have done then you can apply for PR. You have to write a CDR report to get a positive skills assessment from engineering council of Australia.

But if the engineering council of Australia decides, that the you do not qualify to be a professional of the profession you have chosen on the SOL/MODL, then you are in trouble.

Best would be to contact the Engineering Council of Australia and ask the question.

Q. I have done the following undergraduate/postgraduate degrees (name them.) And I have chosen the following profession on the SOL/MODL.

In case I write a satisfactory CDR, would I be able to get a positive skills assessment for the profession A,B,C on the SOL/MODL.

There is no restriction o any sort in the two yr rule which says that you must complete all your degrees/trade certificates/diplomas in one go.

Therefore, you can complete them at different time with breaks in between.

However, once you have completed your two yr education, you have to apply for PR within 6 months of the declaration of your final results, subject to your successfully completing your degree.

If you want to apply for PR based on your prior work experience in your home country, then you need to fulfil the following requirements.

1. You should be below 45 yrs of age.

2. You should have at least 6 in IELTS in every module.

3. Your occupation in which you have been working for the past 2 years should be in the SOL/MODL.To meet the recent work experience requirement, you must demonstrate that you have been employed in an occupation on the Skilled Occupation List (SOL) for 12 of the 24 months immediately before lodging your visa application.

4. You should be able to score 120 in the points test.

You have studied in a course the total duration of which was 78 weeks. Plus you got exemption for certain subjects. Which reduced the course to further 52 weeks.

Now you have to enrol in another course to study for another 52 weeks.

If you again apply for exemptions, then you will have to study further.

If the total amount of time you studied, EXCLUDING the exemptions, is 92 weeks or MORE, then you satisfy the two year rule.

NO, if you enrol in another degree and only study for one semester, that doesn't satisfy the two year rule.

You should enrol in a graduate certificate or a diploma rather then a degree, as it is necessary to complete the degree/diploma/trade certificate you enrolled in.

Yes you can extend your student visa to enrol in a new degree.

First of all I much appreciate your initiative to help people by setting up an open blog.
Sorry to annoy you but I will ask you the same question just for clarification before making a mistake.
I completed a 1.5 yrs master's degree (Molecular Biology) in 2 years, a total of 24 credits(Completed in December 2007 and returned home in February 2008). Now I am planning to do another semester (July 2008) which will use all the credits of my master's degree and will give me Advanced Master's degree in Biotechnology (32 Credits), I have been a full time international student ever since and just wondering if there is a clause which says the study should be continuous. As I have taken a break will that affect my 2 yr study to apply for 18 months work visa?
As there is nothing on the website about the gap during the studies, so I am a bit afraid to spend more money for nothing.
Also I was thinking that my total time of absence from Australia will be less than 6 months, so there shouldn't be a problem. If you could find a link regarding continuous or study with breaks will be much appreciated.

First of all:

Your study in English is not counted towards the two years period.

Note: English language proficiency courses cannot be used to meet the two (2) year study requirement.

Secondly, you need to study for two years in a degree closely related to a profession listed on the SOL/MODL. This two years should not include any time taken to study English.

Keeping in mind the information you provided you cannot apply for PR.

You need to study further.

Yes that is right.

You must take a course at the same level and related to the same degree.

Now there are various options.

Graduate certificate (normally of 6 months)
Graduate diploma (normally of 1 yr)
Masters (normally of 1.5 yr)

Of course you would be interested in the graduate certificate as that would take the shortest time.

But I am not sure about it so you need to ask a competent lawyer about graduate certificate.

However, I am completely sure about Graduate diploma.

If in case it turns out that you cannot do graduate certificate, then you can always enrol in a graduate diploma, take a semesters' exemption and that would help you out.

Ask a MAARA qualified lawyer if its ok to do the graduate certificate.

First things first, hats off to you for your active participation and help in Study in Australia blog (i read the whole thread). I arrived in Australia in October 2007 for the summer semester studies and will be completing my Graduate Diploma in International Business (8 units) in June 2008. I am planning to do further studies inorder to complete my 2 year studies. TR (and not PR) is my goal at the moment.

So, i have offer for Masters in Marketing (8units) from Griffith University. But, there is a requirement by Griffith on the offer letter which says you need to complete a Graduate Certificate in Business (4units), inorder to be eligible for the Masters in Marketing program. I have not yet accepted their offer.

At this moment, some word of advice from you would be highly appreciated as this is a decision of the lifetime.

I arrived in Australia in October 2007 for the summer semester studies and will be completing my Graduate Diploma in International Business (8 units) in June 2008.

I am planning to do further studies inorder to complete my 2 year studies. TR (and not PR) is my goal at the moment.

So, i have offer for Masters in Marketing (8units) from Griffith University. But, there is a requirement by Griffith on the offer letter which says you need to complete a Graduate Certificate in Business (4units), inorder to be eligible for the Masters in Marketing program. I have not yet accepted their offer.

At this moment, some word of advice from you would be highly appreciated as this is a decision of the lifetime.

Ans: As long as the total time of your study in Australia as a full time international student , EXLCUDING exemptions, is equal to or greater then 92 weeks, you can apply for PR.

Yes you can transfer credits from your previous AUSTRALIAN study. However, if your get exemptions for 2 credit hours out of 4 credit hours in the new degree, then only 2 credit hours worth of study would be counted towards the 92 weeks . Not 4 credit hours.

I dont know how can a course be 2 years (102 weeks) and 76 weeks at the same time.

But to answer your question, if your course is 76 weeks according to CRICOS, then it is 76 weeks and you cannot apply for PR unless you take additional study in a similar degree which is also closely related to a profession on the SOL/MODL.

As long as your total time spent studying in Australia is at least 92 weeks, you can apply for PR.

This doesnt include exemptions or RPL.

Because when you take RPL or exemptions, you reduce the amount of time you have studied.

Example 1:

If a course is CRICOS registered for 138 weeks (3 years) and consists of 24 units, 100% of full-time enrolment would equate to 8 units per year. In that course, a student will have completed two academic years when they have successfully completed 16 units.

That means a student enrolled in that course can be given credit for prior learning for up to 8 units and still complete two academic years study.


Example 2:

If a course is CRICOS registered for 92 weeks (2 years) and consists of 12 units, 100% of full-time enrolment would equate to 6 units per year. Students would be required to complete all 12 units to meet the two year study requirement.


A student enrolled in this course who is given any credit for prior learning will not have completed two academic years study and may have to complete an additional degree, diploma or trade qualification to meet the two year study requirement.

If your course is registered as 2 yrs, 102 weeks or 92 weeks in some cases, then you cannot take RPL or exemption unless you have studied previously in another Australian university and the result of that study was a degree/diploma/trade certificate.

Although you have studied for two yrs in Australia, both the degrees you have done are not closely related to the profession you want to chose on the SOL/MODL.

All of your two yrs study must be closely related to the profession on the SOL/MODL.

So you cannot apply for PR under the current circumstances.

Now, since I know now that the I.B. and Law will not help because it is not accredited by the acs at all, I am thinking about changing to the master's of commerce at the USYD (major: business information systems which is accredited according to the acs website). There is more confusion now, because I don't know if only the major of the commerce degree is accredited or the whole programme even though the degree is posted on the acs website. Will I get the full CRICOS 72 weeks for this degree or will the assessors only count the releveant IT part? If not, does that mean that I can only take core IT studies?

Since I will not reach the 92 threshold even if i got the full 72 weeks of the degree, I'm thinking about getting a diploma in IT from the acs. However, this diploma I have not found on CRICOS. Let me clarify some thing. The reason you will not be able to apply for PR as of the current state is not because your current degree is not accredited by ACS, but because the multiple degrees you intend to do in future are NOT CLOSELY RELATED.

The end result is the same but I am trying to make you understand the law. A degree not being accredited by ACS is different from two degrees not being closely related.

1. Have studied for at least 92 weeks, full time

AND

2. In a CRICOS certified course

AND

3. The result of the study is a completion of degree(s).

If a course is not CRICOS certified, then you cannot apply for PR using that particular course.

As an international student, if you are interested in applying for PR, you should be aware of the following things

Eligibility

1. You must have studied in Australia for an academic period totalling 92 weeks OR 102 weeks.

2. The degree you studied in must be CLOSELY related to the profession you will chose on the SOL/MODL. If there is no profession on the SOL/MODL that you can chose or is not closely related to your degree, then you cannot apply for PR.

3. You must be able to get a positive skills assessment from the relevant assessing body. The relevant assessing body is listed next to each profession on the SOL/MODL.

4. You must score 120 points to be able to get PR. Other wise you will have to go through other lengthy and expensive ways to do so.

5. You must at least get 6 band in all modules of IELTS.

So check whether the degree you intend to do is relevant to any profession on the SOL/MODL or not?

If not then change your course to some thing which is relevant to a profession on the SOL/MODL.

If yes then check how many points your profession has? 50 or 60?

If your profession has 50 points then do some thing to get extra bonus points as you will be short of 15 points.

Do the points test calculator from this link and see if at the end of 2 yrs study would be able to score 120 points or not?

Also keep in mind that the rules for PR might change any time.

What will you do in case your profession is removed from the SOL/MODL all together. This is highly unlikely but still you should be ready.

Check the course duration of both courses on the CRICOS website and see if it is more then 92 weeks or not.

If you have a ECoE, you can have it cancelled but make sure that you talk to some one in the Uni and see if you can get the ECoE for the other course.

If you get this ECoE cancelled and you dont get the other one then you have to leave Australia after the expiry of your student visa.

From a PR point of view , it will not matter when you lodge the application.

As you can see the web link you have provided shows the course to be 78 weeks which is normally 1.5 academic yrs.

You have already completed a diploma which is normally of one yr. Correct me if I am wrong.

So by the time you finish your second degree, you will have studied 2.5 yrs or 130 (52 + 78) weeks which clearly satisfies the 2 yrs rule/92 weeks pre-requisite.

YES. you are satisfying the two yr rule criteria.

When you say units, do you mean subjects? In my time we only had subjects and each subject was worth credit points. Some subjects were worth 2 credit points, some were worth 3 and some 4 credit points. So can you explain what you mean by units. I am guessing you mean subjects. Right?

In my time full time load was defined as 18 credit points per semester.

So as long as the sum of your credit points you are studying in a semester is 18 or greater, you were considered studying full time.

Now since the statement given on the Immigration website is very confusing, I will consult my lawyer and get back to you on this. I will give you a clear definition of what full time load means.

The other person to give you a clear answer about this would be the international student officer at your university who knows all these things.

So ask him what full time load means? Also if you can then get back to me and tell me what the International student officer has to say about it. Mean while I will get a clear answer from my lawyer.

A course has 12 units and is 102 weeks long as shown on the CRICOS website.

You can take 92 weeks worth of subjects and leave the rest.

The question is how many weeks equate to one subject?

I think by doing a simple calculation we can guess that.

Divide the total number of weeks by total number of units.

102 divided by 12 = 8.5

So if you take one subject off, that will reduce the amount of time studied by 8.5 weeks.

102 - 8.5 = 93.5 weeks.

So if you take one subject off, you will have studied 93.5 weeks just enough for you to fulfil the 2 yr study requirement.

But the above formula has been made by me.

I do not guarantee the accuracy of the information I provided.

You should double check that with the department of immigration by visiting their local office and ask some one to give you an accurate reply.

Remember that the main help desk person in the office is not the right person to ask. Ask the main helpdesk person to put you in touch with some one knowledgeable.

If the help desk person refuses, do not take his word. Ask him that you want to speak to his supervisor.

Make sure you talk to the right person.

But I am confident that the formula which I have made is correct.

I gave a detailed reply to your question.

I think your question is whether changing your courses affect your eligibility for PR or not?

Ans: No, changing courses doesnt affect your eligibility for PR provided you fulfil the following pre-requisites

1. All your degrees/diplomas are closely related to the profession you chose on the SOL/MODL. You cannot study one degree in Engineering and the other in IT.

2. You must have studied and completed your degrees for duration of 92 weeks.

3. You must have studied on a full time load basis.


Now one more thing I would inform you is that since your EcOE was given to you for studying management degree and now you are changing it to an engineering one, it is worth while to inform DIAC of the change just to be on the safe side.

So get the ECoE from the second uni for the engineering degree you want to do and then inform the DIAC and they will tell you of any procedures that need to be done.

Before I explain any thing else, I would like to inform you that are supposed to apply for a positive skills assessment from Engineering Council of Australia and NOT FROM ACS.

Your degree is related to engineering. When you chose telecom engineering on the SOL/MODL, you will see that the assessment body listed next to it is Engineering Australia and NOT ACS.

Secondly, I hope you have not made the mistake of doing a graduate diploma in a non-engineering degree.

Because the DIAC might consider both of your degrees not related to each other. Both of your degrees should be in engineering professions. You cannot have one in IT and one in engineering.

Last of all, engineering Australia assesses you based on your under graduate degree. So you could have applied for a positive skills assessment to engineering council on the very day you arrived in Australia.

Now you will be in big trouble if your under graduate degree is not in engineering because that would mean that engineering council is not going to give you a positive skills assessment.

And since you can not chose a non-engineering profession on the SOL/MODL, DIAC will not accept you choosing a profession on the SOL/MODL other then engineering.

So I hope you have a undergraduate degree in engineering and that your graduate diploma is also in engineering.

Now coming to your question.

YES you can apply for assessment from engineering council at any time because they are going to assess you on your undergraduate degree NOT post graduate degree.

Check the guidelines of engineering Australia from their website.

Thank you for your response my Master in Telecommunication from RMIT , consists of 8 subjects out of 12 related to IT(networking), full time.These are related to Network Engineering,Advanced Network Engineering ,Network Planning, UNIX Admin, Network Infrastructure ,Internet communication Engineering ,network security ect in totality 8 related to core Networking.
And my grad dip is in Network Engineering which is in same department ( 6 IT related subjected out of 8,full-time) ,in this I got 4 exemption from earlier subjects and rest are Windows System Admin and Web servers and web technology and one more not related to IT.
ACS website says in 1.5 years you should have 2 sem full-time IT related subjects .I think now it's
more clear , so can you help me now

Yes as per the course contents of your degree, you have studied more IT then telecom so you can get a positive skills assessment from ACS.

No problem with that.

Yes you should go ahead with getting a positive skills assessment from ACS but it will be worthwhile to wait and get a positive skills assessment based on both your diploma + 1.5 yr degree as the immigration department might raise an objection saying that you have studied two yrs but you have been assessed based on 1.5 yrs.

Its just an extra safety measure as the DIAC should not say so but if it does say that it will be a an extra hassle to solve.

So you wait till you complete your diploma.

Waiting doesnt affect your application eligibility for PR.

You can apply for PR even after your diploma but make sure you do that within 6 months of completing your diploma.

Do not loose heart as good and bad times do come.

I have gone through bad times. The key is consistency. So work hard consistentaly.

If you fail in a subject, that has no impact on your eligibility for PR.

However, you might face issues renewing your student visa as these days they have started toughening the laws and they expect you to finish your degree within the specified time.

You were supposed to study a total of 16 subjects in 104 weeks.

Every subject is worth 104/16 = 6.5 weeks.

Since you didnt do three subjects, you actually studied for 104 - (6.5 X 3) = 84.5

So if you study two more subjects it will make it 84.5 + 13 = 97.5 weeks.

So you have to study another two subjects.

Make sure the extra study is part of a CRICOS program and you study with a full time load in a degree/course/diploma which is

1. Related to your previous degrees

AND

2. Related to the profession you choose on the SOL/MODL.

Here is what the process is.

1. You apply for positive skills assessment from engineering Australia assessing body.

2. Engineering Australia gives you a positive skills assessment in a particular profession of their own choice depending upon your undergraduate degree.

3. You apply for PR.

4. The immigration department checks the following things

Pre-requisites

i. Have you studied for 92 weeks?
ii.Is the profession you have chosen on the SOL/MODL closely related to the degrees you have done?
iii. Do you have a positive skills assessment from your assessing body?

If the answer to the above questions is YES, then they consider your application.

Here is the catch, by studying this degree which has more of IT subjects, you get in trouble with the DIAC because they are NOT CLOSELY related. Your second degree, as per your own saying is more of IT then electronics engineering ( as you want to apply for electronics engineer on the SOL.)

Has IT subjects got any thing to do with electronic engineering?

Secondly please remember, that you can only claim points for MODL professions if you have relevant work experience in them.

Yes you are fulfilling the two yr requirement but in my opinion these two degrees are not CLOSELY related although both have engineering in their names. If the case officer wants to evaluate the relation between the two degrees based on their contents, then you will be in trouble. But if the case officer is a dumb idiot and evaluates the relation between the two degrees based on their names then it would be your lucky day.

You can check this by checking the classification of the degrees on CRICOS website.


Send me the CRICOS codes for both the courses and I will help you out.

In the end it comes to the case officer who is presiding over your case. If he wants to create trouble he can create it.

So why take the risk. Keep it safe.

N.E.C stands for Not else where classified.

So the CRICOS website is already telling you that this course is recognised by Engineering Australia.

However, there are two problems

1. Engineering Australia assess you based on your under graduate degree. Not postgraduate degree.

2. DIAC requires you to have studied in a course relevant to your chosen profession on the SOL/MODL.


Now your question would be why I am recommending you to take this course?

Right?

Because, of the following reasons

1. You would complete 2 yrs requirement.

2. You would satisfy DIAC's requirement of choosing a profession on SOL/MODL closely related to your studies that is Engineering and Related Technologies, n.e.c.

3. You would easily get positive skills assessment from Engineering Australia because you have a electronics undergraduate degree.

If I am you, I would steer clear of any thing to do with MBA.

As I said, do the degree which has the word Engineering in its title.

But when you are studying the courses, you can study as many MBA subjects as you want.

As I explained earlier, the DIAC case officer is not concerned with the contents of your degree.

He just wants you to get a positive skills assessment from Engineering Australia and then chose a relevant profession on the SOL/MODL.

Dont take chances with the immigration department.

Once you get your PR, you can do as many MBAs as you like.

What I understand from your post is that you are enrolled in the following course.

Course Name: Advanced Diploma of Information Technology (E-Business Analysis)
CRICOS Course Code:054298G
Duration (Weeks): 104

Now it will be better not to take any exemption while studying this course however as per rules you can at least take an exemption of one subject. I just giving you an estimate. Give me the weblink for your course and I can tell you the exact number of courses you can get exemption from in the course 054298G.

As this course is a under graduate diploma and also it is a diploma not a degree, that is why it is at an associate level.


ACS has not mentioned what is the difference between associate or professional but certainly you can easily see that 4 yrs courses are assigned a professional level. While diplomas are assigned a associate level.

From a PR point of view if you do this course, you will fulfil the two year requirement but you will run short of 10 points as associate level courses are assigned 50 points. Where as professional level are assigned 60 points.

If you enrol in the course 053728K. Then you do not fulfil the two year requirement. as it is 78 weeks only although it is a bachelor degree.

I tried to lookup the name of your university on the ACS website. I couldnt find it.

Make sure your courses are accredited by ACS, other wise you will have problems getting a positive skills assessment from ACS. If you do not have a positive skills assessment from ACS, DIAC will reject your application.


In short you have to enrol in a course which is of at least 92 weeks or more in duration and is at a professional level.

You cannot study in advanced diploma and bachelors degree at the same time.

Bachelors degree is for 78 weeks.

The diploma is for 104 weeks.

Although both of them share the same subjects, but to complete the two year requirement you have to study more subjects. This means that by the end of 78 weeks you will have completed your bachelors degree but to fulfil the two year requirement you have to study more.

As mentioned earlier, you can take an exemption of one subject ONLY.

Check the total duration of the course your wife is going to enrol in by visiting the website

It depends upon the case officer.

When I was renewing my visa, my case officer did ask for financial documents because I was renewing my visa for one yr.

My friend who was renewing his visa for 6 months was not asked for providing financial documents.

As per the DIAC website,

"It is a measure of the amount of study you have completed rather than how long it took you to complete the study."

What matters how much amount of study you have completed and NOT how much time you took to complete the study.

So if you complete a degree of 10 yrs in 1 yr, you will still be considered as having completed a degree of 10 yrs. Not 1 yr.

Similarly if you fail 10 times and complete a degree of 1 yr in 10 yrs, you will still be considered as having completed the degree in 1yr.

However, if you take any prior exemptions and reduce the amount of actual time to 91 or less then 91 weeks, then you will be in trouble.

Since the duration of the course is 104 weeks, you can get an exemption for only one subject.

Total amount of time = 102 weeks
Total number of subjects = 16

Week per subject = 102/16 = 6.375

So when you study one subject, you complete 6.375 weeks out of the 92 weeks.

So if you get an exemption of one subject, the total amount of time you would have studied would be 102 - 6.375 = 95.625 weeks.


Which means that you can

1. Take an exemption for only one subject in this course

2. You can complete the course in any amount of time whether earlier or later

and still be eligible for PR as per the current rules and regulations.

No further stay is normally stamped on the visas of those who are applying from outside Australia and getting a visa for less then 6 months or less.

But still be careful just in case your case officer decides to stamp it on your one too.


Even if he does, you can apply for another student visa or graduate skilled visa.

Did you complete the studies earlier? Like in 1.5 years.

If you have completed a 2 year degree in 1.5 years, it would be still considered as 2 years.

This is what the immigration department web site says.

"Two (2) academic years study means the equivalent of two (2) years study enrolled at 100% of a full time load. It is a measure of the amount of study you have completed rather than how long it took you to complete the study."

So if you have completed a two years degree, even if you did that in one year, then you are eligible for applying for PR.(For TR there is a different requirement and the two year rule doesnt apply for TR.)

Your case is a little bit twisted in one way.

If you read the actual legislation on the following page

http://www.immi.gov.au/skilled/general-skilled-migration/885/eligibility-study.htm

It says

Each qualification that you have completed and are relying on to meet this requirement must:

be either a degree, a diploma, or a trade qualification

have been undertaken at an Australian educational institution in Australia

have been conducted in English
be registered on CRICOS


So as per the legislation your graduate certificate is not counted in the list of education you have completed. Only degrees, diplomas or trade certificates are counted, however, because the graduate certificate you completed counted towards the Masters degree you later on completed, I would say that you have a case.

If as per legislation your certificate is not counted then you have to study additional subjects and do at least a diploma (get exemption based on your prior studies and finish a one yr diploma in 6 months instead of one year.)

However, if some how you can argue your case and get your certificate counted, which I dont think is possible, then you can apply for PR.

I would suggest you contact a lawyer before you proceed as lodging an application when pre-requisites are not met can mean that your application is rejected at a later stage and a waste of $2000 application fees.

I am studying Monash's IT Bachelor course. Due to the credit transfer from my home country, they had admitted and granted me 60 credit point examption. The requirement credit point to graduate is 144. This ended up that I need to study 84 credit point or 14 unit.

As an international student, I taking full load which is 4 unit per semester. So, I have 4,4,4 and 2 unit for last semester. The CoE shown that my ciyrse stater date as 16/07/2007 and coyrse end date is 31/07/2009. Do I meet the require of Australia's Two Year Rule" ?


Besides, the rule only stated two year study period. Does not say about holiday. If I go back my home country for summer around 3 months (110 days) , does it affect my requirement ?

I was doing IMBA from griffith university which is 2 yrs but it had a requirement of maintaining a GPA of 4.5 but I failed in 1 subject due to which GPA fell below 4.5 and I have to leave the course with a graduate diploma but for this diploma I have to repeat 1 subject in this semester and then I can do another course so my question is that doing just 1 subject this semester would affect 2 yr rule or not as it stands in middle of my 2 yr studies.

From your information, here is what I know about the degree you are doing.

1. The total number of units in the degree are 24.

2. You are supposed to do only 14 units as you have an exemption for 10 units.

3. The actual duration of the degree you are enrolled in is 3.42 years or approx 3.5 years OR 178.28 weeks.

4. So as per the immigration departments website, http://www.immi.gov.au/skilled/general-skilled-migration/885/eligibility-study.htm,
you are supposed to study at least 14 subjects to be able to fulfill the two year study requirement.

24 subjects divided by 3.5 yrs is 6.85 subjects per year OR 6.85 multiplied by 2 is equal to 13.71 subjects in two years or approx 14 subjects.

So as far as the two year requirement is required, you are on track to fulfill the two year requirement.

However, I am not sure if studying only 2 subjects in the last semester would affect your fulfilling the pre-requisite or not as it is necessary to have studied on a full time load in every semester.

Please confirm this issue with a qualified lawyer.

Just to recap every thing I have said.

1. You only need to study 14 subjects in your current degree to be able to fulfill the two year requirement.

2. You should confirm with some one if studying only two subjects in the last semester would affect your application for PR.

So you are saying that by the end of two years, you will have two degrees/diplomas? Right?

And each degree/diploma will have taken 2 yrs to complete . A total of two yrs.

No, doing this one course will have no effect on your PR application as you fulfill the two yr study requirement.

out of that i completed 6 units and opted to exit for graduate diploma in accounting which is of 1 year cricos registered i.e. 52 weeks, without any exemptions.
I then changed to another course provider with same Master of accountancy 2 year program with 12 units in the program. ( note the difference between the two uni, the earlier one was offering 16units and this one is offering 12 units with same 2 year duration)
this uni. gave me exemptions only for 5 out of 6 units which i had done in old uni. Now i have to do 7 units in this new uni. to complete my masters. My question here is that whether can i take 1 more exemption from my overseas education and still satisfy the 2 year requirement of 92 weeks for PR?
course registered is for 104weeks.

You fulfill the two year requirement if the following is true.


1. You studied in a graduate diploma in accounting in your first year.

2. You exited the program and went to another degree, Masters of accounting.

3. The second degree you are doing is registered as 104 weeks.

4. You have been given an exemption of 5 units out of a total of 12 units by the new uni you are studying at.


Now lets do the calculation


Your new course is of 104 weeks in which you have to study 12 subjects.

You have already studied for 52 weeks from your previous study.

You need to study for another 92 - 52 = 40 weeks.

So you need to know how many subjects from your new degree equate to 40 weeks.

So according to calculations in your new degree:

you need to study (12/104) X 40 = 4.61 approx = 5 subjects to fulfill the 2 year study requirement.

So if you can get your new diploma/degree after 5 subjects, then you can save money, get degree and still fulfill the two year requirement.

The only problem would be whether you would be still be studying under a full time load or not?

So try to do things which satisfy all of the following

1. You fulfill the two year study requirement.

2. You study under a full time load.

3. All your studies are closely related with each other as well as the profession you chose on the SOL/MODL.

To briefly answer your question, Yes you can take exemption for another subject.

If I am not wrong, each subject/unit in this course is worth 6 points, a total of 72 points, 12 subjects/units.

You are getting an exemption of 8 subjects (48 credit points.)

So you are only studying the remaining 4 subjects. Right?


If that is the case, then you do not fulfill the two year requirement as the immigration department website clearly mentions that the total period of time officially required to complete a diploma/degree must be at least 92 weeks.

The total time required for you to complete your current degree is not 92 weeks or more since you have taken exemptions.

Yes you can apply for PR after studying for two years and completing your diploma/degree.

Whether you will get 40 points or not depends what profession you select on the SOL and then whether your assessing body gives you a positive skills assessment based on your studies.

So check the website of ACS and see whether the degree/diploma you are doing is listed on their website and what is the skills level assigned to it. Associate or professional.


25 for ielts
5 for australian studies
10 for work expreance in my field
10 for future job offer letter.




You will get 25 points for IELTS only if you get 7 band in all modules of general or academic version of the test.

You will get work experience points only if you have worked for 1 yr in the past 2 years in your field of profession you selected on the SOL. Any previous work will not be counted.

You will only get points for job offer letter if you are offered a job.

The only condition which will be imposed on you will be 8539 which says that


While the holder is in Australia, the holder must live, study and work only in an area specified by the Minister in an instrument in writing for item 6A1001 of Schedule 6A, as in force:

(a) when the visa was granted; or

(b) if the holder has held more than 1 visa that is subject to this condition — when the first of those visas was granted.

So it is not necessary that you work in the profession you selected for sponsorship however you must work full time and live in the specified area for at least 24 months out of which you must work full time for at least 12 months.

If you are applying from overseas, you will be applying for 176.

If you get 176, then the following conditions apply

* remain in the State or Territory for a period of at least two (2) years

From the immigration regulations, I didnt find any restrictions regarding type of work being under taken.

If the department objects to the type of work you do; such a decision can be challenged in the court.

However, this is only my opinion.

What PR sub class have you already applied for?

I think you must have applied for offshore migration visa subclass 175 or 176.


Once you finish your MBA, you would be able to apply for graduate skilled visa subclass 485 graduate skilled visa.

You can also apply for PR but since you have already applied for PR, there is no need to apply again.

You can still apply for the visa even if you have finished a two year degree in 16 months.


Graduate skilled visa is for 18 months and allows you and your spouse to have unlimited work rights.

Hey mate, could you please help me? I have just completed my commerce degree at USYD (3 year, full time).

However, I cannot apply for Sub 885 at the moment as I cannot meet the pass mark of 120. Therefore, I decide to do the 'Professional Year program', which takes me another one year to complete and this could give me 10 points.

My question is: by the time I finish my Professional year program (one year after my university degree), Do i still meet the two year study requirement? ( I am worrying about this as the professional year program is non-CRICOS course, This would mean I don't qualify to claim any point for 2 year study as I wouldn't be able to submit within 6 months after I complete my university degree。)

Before I answer your question, let me tell you that you can only study in a professional year approved by the Immigration department. If you study in a professional yr not approved by the DIAC, ... bad luck.

Now, you can only study in a professional program if you are on a 485 visa or a Bridging class A visa.

Hey mate, I really appreciate your previous response! Just one last question: Regarding to the two year study requirement, you said to me that when I apply for 885, I do not need to meet this requirement if I am a holder of 485 as I am not an international student any more.

However, I couldn't meet the pass mark (120) if I am not be able to get 5 points from two year study requirement (Australia qualification).

Here is my calculation:
age: 30
Occupation: 60
IELTS: 15
Professional year: 10
Australia qualification (as a result of two year study): 5
Total: 120

As you can see, that 5 points are very important for me. So would I be able to get 5 points after the completion of Professional year Program? Thx in advance.

If you visit the following URL

You will see that you have three options to apply for 885. As an international student, as a holder of 485 visa and as a holder of Trade skills training visa.

Now if you check the requirements of applying as an international student and check the requirements of applying as a holder of 485 visa you will see the difference that when you apply as an international student, you are required to meet the 2 yr study requirement.

But when you apply as a 485 visa holder, you are not required to meet the 2 yr requirement.

The points you are mentioning can still be obtained if you are applying as a 485 visa holder as it simply says that

"You have met the two (2) year study requirement. 5"


It doesn't place any time restrictions.

The time restrictions are only in the case of applying for 885 within 6 months if you are applying as an international student.

You can claim points for Australian qualifications even after 20 yrs provided the qualification was a result of two yrs of study in Australia from a CRICOS certified course and all instructions were in English.

Regarding to 'two year study requirement', the website says:

'You must have met this eligibility requirement in the six (6) months immediately before the date of making your application.'

I don't understand why such statement is here.
Does it mean I must apply for independent skilled migration visa within 6 months after the graduation?

End is defined as the day your results were released officially by the university.

I started a 2 years course in march 2007 and end in november 08. we are supposed to take 4 units per semester and i did take 4 units every summer except the last semester where i took 3 subjects. however, i did take one subject during summer 2009. I failed 3 units and intent to take 2 of them at another university starting from march 2009 to june 2009. by the time i finish my course, it would have taken me 2.5 years to complete my 2 years course. do u think i will be eligible to apply for pr if i take some of units i failed at another university? thank u again. take care..

So you studied

1. 1 yrs Masters from July 2007 to July 2008

2. 5 Months of TAFE diploma

3. 5 months certificate IV

Now there is one problem.

For all professional professions on the SOL like accountant , IT professional etc, you need to have studied for two yrs in a degree, diploma. NOT A CERTIFICATE. Certificates are not counted towards the two yr rule.

What you need to do is to enrol in another diploma and get exemptions based on your certificate and complete the diploma in 5 months instead of one yr.

Secondly are you sure that the diploma you studied in was a diploma and not a certificate because normally diplomas are of one yr. Not 6 months.


Also you need to make sure that all the courses you studied in are CRICOS certified.

If you can give me the CRICOS codes of all the degress/diplomas you have studied in, I will be able to give you a better answer.

Please also read the two yr rule for a clear understanding of the law.

So briefly, right now you are not eligible to apply for PR as you dont fulfil the two yr rule.

You have sent me two links.

One is for a diploma the other is for a certificate. So that certificate will not be counted. Try taking additional subjects and convert the certificate into a diploma too.

I remember you mentioning a degree. Was that degree a undergraduate degree or a post graduate degree?

The rule is that all your studies have to be at the same level. So you cannot study in a masters degree and then to fulfil the two years rule study in an undergraduate diploma or degree.

You must then study in a higher level of program.

So if your 1st degree was a post graduate degree, then the rest of diplomas must be also at the post graduate diplomas.

But if your first degree was at the under graduate level then your diplomas can be under graduate level too.

If you initially enrolled in a one year course then your visa will be of one yr.

So if you again want to enroll in another degree you will have to renew your visa and go through the same process again.

Yes you need to show funds worth 2 yrs if your degree is of two yrs.

Go to this link and try searching using the course CRICOS ID

You will get an error saying that incomplete number of characters.

All you need to do is

1. Check the CIRCOS code of the degree that you will be given finally when you finish your 2.5 yrs study.

2. Put that CRICOS code in the link I gave you and check the duration of the course.

If the duration of the course is more then 92 weeks then you are eligible for PR. If not then you are not eligible for PR.

You do not need to go into that much detail.

Just look up the duration of the degree that you will ultimately get when you finish your study.

If its a valid CRICOS code then why can I not search it on the CRICOS website?

Either you are giving me an invalid course ID or that course is not CRICOS.

Just check what is the duration of the degree that you will finally get on the CRICOS website. If the duration is more then 92 weeks, then you are eligible for PR if not then you are not eligible.

Changing institutions doesn't matter.

I am 42 years of age (23 Jan Bday) applying for a 2 year Master of Professional Accounting in CSU starting July 2009. Which means I will be completing the course when I am 45. At the end of the course I qualify for a CPA qualification.

Will I be able to apply for PR on the basis of the qualification assuming I complete the course successfully by Jul 2011? What are my chances of getting a PR at that time?

I must applaud you for taking the effort in answering everyone's enquiries in such detailed manner.

I have completed my Master of International Business at an Australian university. The CRICOS code for my course is 054753A and it is registered as a 104-week course. Please refer to: http://cricos.deewr.gov.au/Course/CourseDetails.aspx?CourseID=54753

On my CoE, I was given 1.5 years to complete the course. The postgraduate programs at UniSA are conducted on the basis of 4 terms a year (1 term is equivalent to 3 months). My course consisted of 12 subjects. I took 2 subjects in each term so I managed to complete my studies in 1.5 years (6 terms). There was only a one-month holiday during the 1.5 years.

I understand from the DIAC website that in order to meet the 2-year study requirement, I must undertake a 2-year full time study at an Australian university and the study must be completed in no less than 16 academic months.

Am I eligible to apply for PR/TR? I am intending to apply for either visa subclass 885 or 485. I have called the DIAC several times to enquire about this but the operators that I spoke to could not give me a valid answer.Please advise. Thank you very much.

You can see the following break down for age

18 to 29 years 30
30 to 34 years 25
35 to 39 years 20
40 to 44 years 15

Once you cross 44 that is you make it to your 45th birthday, you become 45 yrs old.

So if you can lodge your application a day before your 45th birthday, you can still get 15 points for age.

But if you lodge it on or after your 45th Birthday, then you cannot apply for PR.

I dont understand why you got a visa of 16 months when the official duration of the course is 104 weeks?

Any way, If a course is CRICOS registered for 92 weeks (2 years) and consists of 12 units, 100% of full-time enrolment would equate to 6 units per year.

Your course was a 2 yrs course and you were required to complete 12 subjects. So if you took 6 subjects per yr, then you fulfill the 100% load requirement.


But I find it strange that you were given 16 months to finish the course where as the course itself is 24 months course.


Last of all if you fulfill the requirements below, you can apply for PR/TR


A person satisfies the 2 year study requirement if the person satisfies the Minister that the person has completed 1 or more degrees, diplomas or trade qualifications for award by an Australian educational institution as a result of a course or courses:

(a) that are registered courses; and

(b) that were completed in a total of at least 16 calendar months; and

(c) that were completed as a result of a total of at least 2 academic years study; and

(d) for which all instruction was conducted in English; and

(e) that the applicant undertook while in Australia as the holder of a visa authorising the applicant to study.

Hope this helps.

Please note that there are other things to be considered while applying for PR/TR. Right now I have only talked to the two yr requirement.

This point means that you can enroll in a 2 yr course but you cannot finish it in less then 16 months. For example if you enroll in a 14 subjects degree of two yrs you can complete it in one yr by studying 6 subjects in a semester and 2 subjects in the summer.

Although you would have studied a 2 yr degree but then you would have finished it earlier then 16 months and the 2 yr rule will not be fulfilled.

(c) that were completed as a result of a total of at least 2 academic years study

2 yrs of academic study means that you finishes a course which is registered as 92 weeks with CRICOS. You can finish the course earlier in 16 months but you would have still studied 2 ACADEMIC YRS.

ACADEMIC YRS is different then actual time.

You can finish it either in 16 months of 2 yrs or 3 yrs. But not less then 16 months.

- Completed undergraduate degree (Bachelors of Business and Commerce - Major in Marketing & Management) from Monash University.
- Course duration is 3 years.
- Spent 1.5 years studying in Malaysia and the remaining 1.5 years in Australia (Melbourne, suburb : Berwick).
- date of study in Australia : mid 2005 untill end of 2006 (1.5years in total or 3 semesters)

I left Australia immediately after completion of my study. At June 2008, I returned to Australia to do my Masters of Business Administration at RMIT. The course runs for 1 year and it is trimester based. I have completed the first semester and is currently doing my second semester. From here, I would like to know my chances to apply for a TR or a PR. And below are the issues that's been surfacing :

1) The 2 year study rule. My undergrad in Australia gives me 1.5 years. My current MBA, 1 years. Total will be 2.5 years. Question : Do I satisfy he study rule given the fact tha I have not continued my studies consecutively?

All of that is getting bonus points for Australian qualifications.

If you have just studied for 2 yrs then you only get 5 points.



You have studied for 1.5 yrs in an undergraduate degree

AND

You have studied for 1 yrs in an postgraduate degree.

In total you will end up studying 2.5 yrs.

Since all your study is less then 3 yrs, you will get 5 points.

If you can study for at least 6 months more, you can get 15 points.

You need to

1. Enroll in another diploma/degree to complete 2 years of education.

2. The new diploma degree you enroll in should be closely related to your previous degree as well your nominated profession.

3. The new as well as the old diploma/degree should be CRICOS certified.


after doing master of graphic design what profession i can take on MODL or SOl

You need to nominate a profession which is closely related to the graphic design profession.

You can either nominate

Graphic Designer 2533-13 which is a 50 point occupation

OR

Computing Professionals – (nec) 2231-79 which is a 60 point profession.

I would suggest nominating the 60 point profession.

However, I cannot guarantee you that whether ACS will give you a positive skills assessment for the 2231-79 profession after a graphic design degree.

If ACS refuses to give you a positive skill assessment for 2231-79 based on your graphic design degree, then your option would be to nominate the 50 point profession.

As a suggestion I would say to do a degree which is listed on the ACS website.

Junaid I wanted to know that i have done masters in travel and tourism in Australia and the course duration was for a year, then i went back to my home country for 6 months and came back to Australia and currently i am doing masters in hotel management and the course as far as i know are interrelated and the duration was 2 years which has been decreased by 3 months by the hotel school authority, so i want to know can i apply for PR by clubing both of my master degrees which i think are interrelated and is there a problem for the 6 months gap between 2 courses, am i still eligible to apply for PR after finishing the second masters, please help me i am really worried and confused.

Now after a gap of 14 months(i joined diploma in bussiness in between) i want to do continuation of Public health(total 8 subjects) which is Population health(total 12 subjects),92 weeks,2year masters.The uni is giving exemptions for 8 subjects of public health ,so only 4 more to finish for population health.

I also took a break in my study when I finished one course and I came back after 6 months to do another course. I recently got my PR without any trouble. The rule doesn't say that the course should be continuous, all it says is the course or related courses should total up to 2 years of academic study...

Yes you can club these two degrees together.

However, my question is how many exemptions you will take in both the degrees or just one degree.

Every time you take an exemption for a subject, that reduces your time studied by around 6 weeks.

So if you dont take any exemptions or just take exemptions which do not deduct your time so that it becomes less then 92 weeks then its ok.

But if your total time studied is less then 92 weeks, you will not be eligible to apply for PR.

Use the formula given to calculate the two yr study period.
