The Two year rule

PLEASE NOTE THAT AS OF 23RD MARCH, 2013, International students can no longer directly apply for PR after studying for two years.

The two year rule is still valid in many situations. However, International students should not be tricked into believing that they can get PR just by studying for two years in a degree which is closely related to a profession on the SOL.

What is the two year rule?

Its very important to understand the two year rule.


The two year study requirement was introduced in July 2003 in recognition of the value of Australian study in equipping visa holders to find skilled employment and settle easily in Australia. The intention of the two year study has always been to ensure that applicants for GSM have a strong foundation of at least two academic years study in Australia. The value arises not only from having an Australian qualification but from having substantial exposure to Australian society and culture.


The Government has amended the Regulations to clarify the two year study requirement in response to some confusion surrounding its interpretation.

From 1 September 2007, to meet the two year study requirement, applicants will have to complete one or more degrees, diplomas or trade qualifications for award by an Australian educational institute as a result of a course or courses:

  1. Registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS);

  2. Completed as a result of at least two academic years’ study;

  3. Completed in a total of no less than 16 calendar months; and

  4. That the applicant studied in Australia, while holding a visa that allowed study and for which all instruction was conducted in English.

In addition:


  1. Students will not be penalised for changing education providers provided they obtain credit for their previous study and this study was in a CRICOS registered course undertaken in an Australian institute while physically present in Australia and in accordance with any visa conditions.

  2. In line with the National Code 2007, students will also be able to count study undertaken online towards meeting the two year study requirement (up to 25%), if they were in Australia for the duration of that period of study.

These changes benefit students because they allow more flexibility.

What is two academic years?



To demonstrate that you have studied for at least two academic years, you must show that you have completed the equivalent of two years study at 100% of a full-time load. If you are given credit from prior learning it will reduce the amount of study you have completed.


The department will use CRICOS to determine whether a course meets the two year requirement. From 22 October 2007 a course that has a registered duration of 92 weeks will be accepted as a course equating to two academic years of study.

Examples:

  1. If a student completes a full qualification in a course that is registered as 92 weeks, they will have met the two year study requirement.

  2. Where a student completes two eligible qualifications, each related to their nominated occupation, that together total at least 92 weeks registration on CRICOS, they will have met the two year study requirement.

  3. Where a student enrols in a three year full time course, they can be granted recognition of prior learning or credit for up to one year of full-time study and still meet the two year study requirement (as defined above) when they complete the qualification.

  4. Where a course is CRICOS registered for 92 weeks a student enrolled in this course who is given any credit for prior learning will not have completed two academic years of study. In this situation, the applicant would need to have (or complete) an additional eligible qualification related to their nominated occupation in order to have completed, in total, the required two years of academic study.

  5. If a course is CRICOS registered for 92 weeks but a student elects to complete the course through accelerated learning, for example through a summer semester of study, the student is considered to have met the two year study requirement if they complete the course in no less than 16 calendar months.

  6. If a student enrols in a course that would only require 1.5 years to complete full-time but has taken two years to complete, this will not have met the requirement for two years of academic study.

Example 1:
If a course is CRICOS registered for 138 weeks (3 years) and consists of 24 units, 100% of full-time enrolment would equate to 8 units per year. In that course, a student will have completed two academic years when they have successfully completed 16 units. That means a student enrolled in that course can be given credit for prior learning for up to 8 units and still complete two academic years study.

Example 2:
If a course is CRICOS registered for 92 weeks (2 years) and consists of 12 units, 100% of full-time enrolment would equate to 6 units per year. Students would be required to complete all 12 units to meet the two year study requirement.

A student enrolled in this course who is given any credit for prior learning will not have completed two academic years study and may have to complete an additional degree, diploma or trade qualification to meet the two year study requirement.

My case:

I will explain my own example to make things easy for understanding.
You can see the certificate of completion from my university below.

As you can see the certificate shows two things
  1. The start date and the end date, which is from 28th of Feb, 2005 to 18th of July, 2007. A total of 29 months OR 116 weeks.
  2. The other important thing mentioned is the "Normal full time duration" of the course which is 4 semester (2 yrs or 52 weeks).
Although I completed the course in an extra 6 months, the actual duration of the course is 2 yrs, NOT 2.5 yrs.


So when the immigration department opens your case file, it will look at two things


1. The official course duration as listed on the CRICOS website. In my case, my course is 104 weeks.

2. The total duration of the course in a full time load as shown by the certificate of completion on the letter issued to you by your university.


I hope I have cleared the doubts of every one by providing my own example.

The rule you are talking about is not related to two years study.

That rule in fact says that if you were granted a two year visa to finish your studies, then you need to finish your studies in 2 years. NOT 2.5 YEARS or three years.

Your visa will not be extended unless you are enrolling in a new degree.

Unless you have exceptional circumstances, the department will not renew your visa.

So you are expected to undertake full time load of 4 subjects per semester. You can confirm this with some one from the department of immigration by visiting their office in the city.

Currently, i am working with family business and would be starting with my MBA from QUT in july2009. Here are the course details:

As you can see your course is of 78 weeks.

You need to study for at least 92 weeks in a degree(s), diploma(s) closely related to a profession on the SOL to satisfy the two year rule.

You will need to study in another diploma/degree to satisfy the two year rule.

Plus you need to remember that you should choose a profession which is a 60 points profession.

Choosing a 50 point profession will land you in trouble as you would need to score 10 extra points from some where.

You can get a 18 months full time work permit only and only if you have studied in Australia for at least 92 weeks.

Other wise, the only way you can get a work visa is

1. Either get sponsored for a work visa by a company.

2. Or apply for immigration based on your work experience.

Since you already have work experience why dont you apply for offshore immigration based on your work experience.

Good to see some one from our own to answer all our stoooopid questions. I really hope this blog is still alive.

I want to ask if i am eligible for applying for PR after completing my 1.5 years Masters of Communication. Since there are no good universities which are teaching communication for 2 year, i found this course from RMIT which is of 1.5.

Any other way of learning communication from australia?

You need to study for two academic years to be eligible for applying for PR.

You cannot apply for PR with 1.5 yrs of study.

The course in which i am transfering is also 2 year course with 12 units. They said that on the basis of my studies in first semester they will give me 3 unit exemption means I will complete my 3 units from old uni and rest 9 units with the new one. In this situation can i apply for PR?

Yes you can apply provided your course is a two yrs course.

However, I am not sure what kind of a course are you studying in because most 12 subject courses are 1.5 yrs in duration while 16 subject courses are 2 yrs in duration.

So double check if your course is 2 yrs long or not.

Ya i am 100% sure course is of 2 years in both the uni and both consist of 12 units in total. Is it alright if i get exemptions? after 3 subject exemptions from my previous uni in australia I just have to do 9 more remaining units from new UNI. Can i apply for PR?

Ok if you are 100% sure that the course is 2 yrs even though you are studying 12 subjects, then thats ok.

Plus yes you fulfill the two yr criteria if you study 3 subjects in one uni and the rest 9 in the other.

As long as the 3 subjects from the old uni are towards the award of the degree at the new uni then thats fine.

If they are not part of the new degree then that will not be accepted.

Hi, first of all let me thank you for setting up this useful blog

This is my situation right now

1)I have completed my first Diploma of Commerce with 8 out of 8 subject at Melbourne institute in Australia from 2004-2005.(The course is registered for 52 weeks at cricos for 8 subjects)

2)After that for some stupid reason i transferred to offshore Australian University (Victoria University) campus with an exemption from my previous diploma course from 2006 until end of 2007. I am getting 8 exemption out of 24 subjects. However, on this offshore campus i only did 12 subjects, which leave the other 4 subjects.( the course is registered for 156 weeks for 24 subjects)

3)In 2008 i transferred to (Victoria university) Melbourne campus again and did the 4 subjects for one semester (half year) and got my accounting degree

4) Since i feel that i need another half year to satisfy my 2 year study requirement, i decided to enrolled in another diploma of accounting course for half year. I got 8 exemptions out of 17 subjects. and i did the rest for the half year ( the course is registered for 50 weeks with 17 subjects at cricos)

Now my question is:
1)Will i satisfy the 2 years study requirement?
2)can can i still count my first year study at Melbourne campus for the diploma course as 52 weeks after i transferred to offshore Australian campus and decide to go back?

You need another 40 weeks. Remember academic yrs is defined as 92 weeks. Not 102 weeks.

So you again studied for 26 weeks in Australia. You need another 14 weeks to satisfy the two yr rule.


4) Since i feel that i need another half year to satisfy my 2 year study requirement, i decided to enrolled in another diploma of accounting course for half year. I got 8 exemptions out of 17 subjects. and i did the rest for the half year ( the course is registered for 50 weeks with 17 subjects at cricos)
So you studied for another 26 weeks which is well above what is required.

You satisfy the two yr study requirement.

You must lodge the application for PR within 6 months of the completion of your last degree.

Getting a PR depends on many things.

1. Your ability to fulfill the pre-requisites for applying for immigration.

2. Your ability to score the pass marks.

By studying for two yrs in Australia you are able to satisfy the two yr pre-requisite.

Whether you are scoring the pass marks depends upon what profession you choose on the SOL and many other things.

Ans 1. You will most probably be assessed as an electronics engineer or related profession.


Ans 2. Normally you apply for a new course some where at the end of the last semester of your first degree as you can only have one visa at a time.


Ans 3. Yes you will get eligible relative points for your sister being an resident.

Ans 4. That is your personal choice.

The best would be not to waste money on education if your main aim is immigration.

Apply for offshore immigration and keep your job. Once you get your residency in Australia, start finding a job in Australia and come to Australia once you have found a job.

But its entirely up to you what you want to do in life.

Yes. It is closely relevant. However if you want to apply for onshore immigration, you would need to do study for two academic yrs.

The next degree you enroll in also needs to be closely related to telecom engineering.

may be this question is not regarding 2 year rule but it is definitly rel;ated to immigration.
My wife who is on dependent visa with me has 12+3 Years of education.I am definitly sitting for IELTS to get 7 band each section.BUt is it necessory for my wife also to give IELTS?
I heard from my friend that if means of education for 3 years is english then dependents do not need IELTS.Is it true?
Please advise.

I have done one year diploma of Commerce (52 week: CRICOS) Now i am not sure how to get rest of the weeks to make it 92 week.

Option 1:
I can get enrollment in a Bch in Accounting (2 years CRICOS 92 weeks)

Option 2:
Also i have can do advance diploma in accounting 52 to 40 weeks)

which one should i go for;
CAN I APPLY FOR PR AFTER COMPLETING FIRST ACADEMIC YEAR FOR Degree program or I have to complete my full degree.

Before you apply for PR, I need to know what profession you will nominate for applying on the SOL.

Let me know the name and ASCO code of the profession you will nominate on the SOL and I will be able to answer your question.

The process of applying for onshore immigration is as follows

1. You study for two years in a diploma(s)/degree(s) which is closely related to a profession on the SOL.

2. After completing your diploma(s)/degree(s), you then need to obtain a positive skills assessment from the respective assessing body.

3. You need to score the right score in IELTS.

4. You score the passing mark in the GSM points test.

5. You apply for immigration.

I have already applied for GSM in 2009. I didn't get MODL (because I was classified under Computer Professional NEC)

I have done Master in computer science from Pakistan and have also done MIT in Australia.

at the time of application i had one year (900 hours) part time experience in IT.

To get MODL priority processing

1: can I claim experience earned after my PR application (I got permanent fultime developer)
2: Claim experience gained during MCS in Pakistan

If you want to nominate profession 2211-11 as the profession on SOL, then you must satisfy the following

1. Study for at least 2 academic yrs in a CRICOS recognised degree/diploma which is closely related to the profession you nominate on the SOL. If you study more then one course then all the courses must be closely related to the profession you nominate on the SOL.

2. You also must obtain a positive skills assessment from your assessing body. Please check that after completing the courses you plan to do, would you be able to obtain a positive skills assessment. Contact the assessing body for this question to be answered.

3. You must score the appropriate score in IELTS to be eligible to apply for PR. Please note that certain assessing bodies might require higher IELTS score even to issue a positive skills assessment.

4. You must apply for PR within 6 months of the completion of you degree.

Now coming to your questions.

1. What is the CRICOS code of the courses you are planning to do? and you have studied.

Check the duration of both the courses, the one you have studied and the one you will study on the CRICOS website. The CRICOS website lists the official durations of the courses and that is what case officers consider.

Yes you can enroll in a 2 yr degree and get one yr exemption as you have already studied one yr. Make sure you confirm that at the end of the 2 yrs your assessing body will give you a positive skills assessment.

The MODL has been abolished. You can no longer claim points for MODL.

And since you did not claim points for MODL when you applied for GSM, you cannot claim them now as MODL no longer exists.

You will be awarded points for specific work experience if you have been employed for three (3) of the last four (4) years in an occupation on the Skilled Occupation List (SOL).

You must have been employed:

* for at least 20 hours a week
* in a paid position
* at a skilled level in your nominated occupation or in a closely related occupation on the SOL.

So yes you can claim points for specific work experience even if the work was done after you lodged your application for PR.

I Did master of engineering studies from Univeristy f wollongong and graduated in July 2010. 72 CP in 2 years ..course was regitered as 104 weeks course on CRICOS website. But as university has stopped this course from this year...this course CRICOS code also does not show anything on CRICOS website.

Will it be a problem for GSM application.what u reckon?

No, it will not be a problem.

As long as the course remained CRICOS certified till the end of your degree, you will not have any problems.

Back in my days if you completed a course accredited by ACS (you can check that from their website) it meant you would get a positive skills assessment.

So check if there have been any new rules. I am not aware of any.

Yes you can finish a two yrs course in no less then 16 calendar months and can still fulfill the two year rule requirement.

Check the duration of the course on the CRICOS website.

If the duration is less then 92 weeks then you cannot apply for PR.


If the duration is more then 92 weeks then you can apply.

You also have to satisfy other requirements to be eligible to apply for PR.

Yes, you can change your visa. Once you are granted the visa subclass 175 while you are in Australia, you will have to leave Australia and go to another country to have the visa label stamped on your passport. You can do this from any country. This normally takes 2 to three working days.

457 is a work visa.

I have another question.. I will make it specific now:

My brother qualified as an engineer from GIKI in 2008, and joined shell pakistan in sept 2008as an engineer. Hence, his 3 years qualification requirement for the 175 visa completes in sept 2011.

His objective is to do an MBA and get a PR as well. The issue is, there is a genenral understanding that MBA being too generic in nature, will mean he will most probably require an employer sponsored PR. Is that correct? If it is, I felt that the better option for him would be to wait a bit, aquire the 3 years of experience and apply for 175 instead of coming in as a student.

But I also dont want him to waste any year.

Given that, this is what we are hoping to do.. please guide if this is viable:

The work requirement of the immigration department is one year.

The work requirement of engineers Australia is also one year.

So your brother can apply right now if he fulfills the pre-requisites.

He needs to obtain a positive skills assessment from engineers Australia in A PROFESSION which is on the Skilled Occupation List, SOL. If his profession is not on the SOL then he cannot apply for immigration. Obtain at least 6.5 in all modules of IELTS and score 120 on the points test for the visa subclass 175. If all is OK then lodge the application.

Please note that the points test would be changing in June 2011. So please check if he is going to apply after or before June 2011. My answers are based on the current points system.

Also, there is no guarantee that he will get the 175 visa by the time he finishes his MBA. This has happened in many cases I know. So be prepared to go back just in case the visa is not granted by the end of the MBA.

Yes that is fine. Your work experience must be valid on the day you lodge the application. Check with the work experience requirement in the eligibility section of the points test link I provided you.

You can only apply for PR if your profession is on the SOL. If your profession is not on the SOL then you cannot apply.

Most of the professions which are closely related to MBA are not on SOL or have low points.

So your brother should apply for PR based on his engineering work experience.

If he finishes his study and then applies, then he might face the following two problems.

1) His work experience might have become invalid by the time he lodges the application.

2) There is no profession on SOL which closely matches the MBA degree he completes.

3) His MBA is not of two yrs.

So my suggestion would be to apply now.

Oh and one last question for myself

I have been here for 2 months only. How soon is it advisable to switch from my 457 to 175?


As soon as you have all the pre-requisites ready.

1) Positive skills assessment from assessing body

2) IELTS exam results.

3) 120 points on the points test.

Hello Junaid, I did my one year Masters Of Engineering from ANU and then a six months Certificate in Human Resource Managment from University Of Canberra, Now i am planning to go back to ANU as one of the consultant with whom i discussed my case told me that i might have some difficulty to show relevance between my two courses. In ANU i will be pursuing Master Of Graduate Studies which is a one year program. This program is very flexible in terms of selection of courses and i will be taking some engineering courses along with some management courses related to Engineering.
Now i have asked ANU to give me some exemptions on the courses i have studied in UC and they have nearly agreed t give me exemptions for two courses which means i will have to study six courses in two semester now, although i am also thinking of studying five courses in one semester and then studying a course in summer term.
Now my question is if i study three courses per semester will it affect my two years study requirement? Although initially i taught international students can not take less than four courses/semster but if the Uni doesnt have any objection then my approach is why should i worry? So basically my question is "is my approach right?" Thanks

Here i didnthave much luck in finding a job and am planning to go back to Australia. I have already got an offer letter for a course in UTS. My plan is to apply for TR after doing my degree and then do the professional yr and then apply fr PR. I want to ask a few questions:-
I have heard that they have changed the rules for TR and someone told me i might not be eligible for TR even after i finish my two years study? Is this true?

If you have to study less then 4 subjects in your last semester because you have already completed the rest of the course, than, it will not affect your full time load.

You can only do this once as an international student in Australia.

I would not be able to suggest to you a course which is both cheap, inexpensive and at the same time make you eligible for PR.

Also please remember, that a graduate certificate cannot be used towards the 2 year rule, unless it is part of a graduate diploma.

Once you have selected the courses, let me know and I will be able to comment whether it will make you eligible for PR or not.

Basically I want to ask you your opinion on how to relate my degrees. I am going to nominate electrical engineer as my occupation (http://www.abs.gov.au/AUSSTATS/abs@.nsf/Previousproducts/C9DB32D1BA6F84EFCA2571E20083546C?opendocument). The problem is my master course is 78 weeks long so I am looking for a short course that I can relate to it and catch the 92 week threshold.

I am mostly inclined to Management Diploma courses which give you skills described here: http://employabilityskills.training.com.au/view.php?q=BSB51107.

Now I think I can justify how the two of them can be related, but do you think it is a safe choice or I will be having problems with my application if I get that diploma?

I am currently doing double degree which is Bachelor of IT/Commerce. I commenced my study in July 2008 and completed IT degree in Dec 2010 and still doing another semester to complete my Commerce degree. I got 50% exemptions for my IT degree from poly diploma in SG. I studied here for 2.5 yrs to complete that degree while some credits that I did was for commerce degree. So,can I apply for PR with IT degree while still completing my commerce degree? Will I satisfy for 2 yrs rule with IT degree?

Please use the following formula to calculate the amount of time you have studied. Any subjects for which you were given an exemption are not counted towards the two years time period. Use the formula and see if you studied for more than 92 weeks.

Here is the formula.

T=L X C/U , where:

T= Duration for which the student studied the course.

L= length of course on CRICOS

C = number of units completed by student, excluding exemptions.

U = number of units which would be necessary to complete the studies

Im studying for my Masters in Monash now, which is a 1.5 year course. However, after the first semester I plan to transfer to Uni of Melbourne for a 2 year course, by taking credits for my first semester.

So eventually I will be studying 1 semester in Monash full-time, and the other 1.5 years in Uni of Melbourne. Will this satisfy the two year rule?

If not, will it be okay to complete the 1.5 year course and then do a 6 month related advanced diploma?

Whether you can nominate a particular profession on SOL after finishing your two yr study depends upon the following criteria

1. How closely related your 2 yr degree is to your nominated profession.

2. Whether the assessing body will give you a positive skills assessment in the nominated profession or not.

Please note that just by studying two yrs does not make you eligible for a positive skills assessment from any assessing body.

In your case, if you are nominating accountant profession, then, you must check what the requirements of your assessing body are and whether your degree will lead you to a positive skills assessment from that assessing body based on your two yrs study.

If not, then the DIAC will reject your application.

So I just checked the requirement to apply as an accountant (general) under the SOL, after completing 2 years of related study.

It seems that I will have to complete 9 out of 12 accounting areas, which will be assessed by the assessing bodies.

It seems I fulfill the 9 out of 12 rule just fine through my Australian bachelors degree, but unfortunately I graduated in January, 2010.

So, when assessed by, e.g. CPA, will they count my more than 6 months old bachelors degree's courses as well or will they only look into my recent Master degree's courses in order to assess my eligibility?

Yes. That is correct. If you nominate Accounting as your profession then you will have to get your skills nominated from one of the assessing bodies you just mentioned. They are all different and will have different requirements. So choose the body which is the easiest to get through.

You will have to check that with the assessing body. In my opinion they can assess your Bachelors degree which you completed in 2009.

I fulfill the required areas of study with my Bachelor degree in order to apply as an accountant.

The problem is not the assessing body.

The problem is that any degree completed 6 months before the lodgement of the application is not considered by DIAC.

So DIAC will only consider the two yr study period which you completed 6 months prior to the lodgement of application.

So here is the solution

1. Get yourself assessed based on your bachelors degree as an accountant.

2. Apply to DIAC based on your Masters degree.

The problem is that DIAC may raise an objection that your 2 yr degree is NOT CLOSELY related to your nominated profession

So you have to somehow get around this problem.

I would suggest discussing this with a good migration agent.

I'm Kristine from Vietnam. In 2008,I finished a diploma of Commerce at SIBT-Sydney (8 units).

RMIT-Vietnam (a branch of RMIT-Melbourne) agreed to give exemptions for all 8 units above, so I only need to complete 2nd and 3rd year study at RMIT.

Now, I am studying 2nd year of Bachelor of Accountancy at RMIT-Vietnam.

What if I finish 2nd year (8 units) in Vietnam, and continue 3rd year (8 units) at RMIT-Melbourne, will I be eligible for 2 year-study in Aus requirement? even though there is long gap between 2008 and 2012.

And is my qualification rewared by RMIT then considered as an Australian degree?

I would really appreciate your help.

In 2012, RMIT-Vietnam (a branch of RMIT Melbourne) agreed to exempt all 8 units above, so I only need to complete 2nd and 3rd year study at RMIT-Vietnam.

Now I'm studying 2nd year of Bachelor of Accountancy at RMIT Vietnam.

What if I finish 2nd year in Vietnam, then continue 3rd year at RMIT-Melbourne, does that count to 2 year-study requirement in Australia? even though such a long gap between 2008 and now?

Is then my Bachelor qualification rewared by RMIT considered as Australian degree?

You are studying a three yr degree and have studied two yrs in Vietnam and will study one in Australia.

So technically speaking, you would have only studied one yr worth of education in Australia.

The fact that you are studying in an Australian university which has a campus overseas does not add to your two yr study period.

The two yr study period must be inside Australia.

Yes you can study another 6 months course but that course must be a postgraduate diploma or degree.

It cannot be a certificate.

The 6 months study that you would need to do MUST be at least a DIPLOMA or a DEGREE and also CLOSELY related to the field of your previous study as well as the profession you nominate on the SOL.

If you fulfil the above mentioned requirements, then, yes you fulfil the 2 yr study requirement.

That is correct. Most professions listed on the SOL are NOT closely related to MBA.

I am not familiar with what the entry requirements are for G8 universities.

Getting sponsored by a company after MBA depends upon lots of things. Having an MBA does not guarantee that an employer will sponsor you.

Do you think that I can get a job after my MBA from a good college/university?

There is no YES or NO answer. It depends upon a lot of things like your skill set, your experience, whether you have work rights or not etc.


I would also like to know about the current job market/situation in Australia as far as MBAs are concerened.

Yes, to fulfill the two yr study requirement you have to study in another degree, which is of the same level as your first degree, for at least one year. But this will only fulfill the two yr study requirement. The rules have now changed and international students can no longer apply directly for PR after finishing their studies.

Yes you can, but as I explained earlier, unless you are covered by the transitional arrangements, you can no longer apply directly for PR.


The problem is that the pathway of getting PR by studying for two yrs is no longer available to international students. Only students who come under transitional arrangements are eligible to apply for PR based on two yr study requirement.

Once you finish your 2 yr study, all you get is a work visa after which if you cannot get PR, you have to return back to your country of origin.

In short, PR is no longer granted ONLY on the basis of study. You have to score points and fulfill some prerequisites to get PR.

There is talk of giving temporary work visas to all international students who study for at least 2 yrs and finish their courses regardless of which course they are enrolled in.

As you can see, at this point in time, only students who have studied in courses related to professions listed on SOL can apply for TR.

Please check the SOL and see whether the course you are studying is closely related a profession on SOL or not.


If there is no profession on SOL which closely matches your course, SOL then you cannot apply for TR then its hard to tell when exactly would the law change

According to the new rules, you first have to get a EOI from the department.

You can no longer apply for PR directly as was the case before 2011.

You will have to go through the same process just as any one else applying for PR from overseas.

If you complete the course which has a duration of 2 academic years in at least 16 calendar months then you would have fulfilled the two yr study requirement.

You can though apply for a work visa which can be of 4 yrs depending upon your situation.

If the CRICOS code that you studied under was 104 weeks then you have fulfilled the 2 yr study requirement.

You might run into trouble if your case officer cannot find the CRICOS code that you studied under.

So in that case, you will have to get extra information from uni to pass on to your case officer.

Let me clarify two things. Studying for two yrs and applying for PR are two different things.

Studying for 2 yrs in a degree or diploma closely related to a profession on the SOL only entitles you to two things

1) Apply for a graduate skilled visa subclass 485.

2) Claim the points for Australian study while lodging an application for a PR visa.

Studying for two yrs doesnt not mean you can apply for PR. You can still apply for PR even if you have not studied for two yr (e.g. applying for overseas skilled migration)

If your degree is of 1.5 yrs then you can enroll in a diploma of one yr after your finish your 1.5 yrs degree and then claim exemption based on your 1.5 yrs degree and this way complete the 1 yr diploma in 6 months.

This way you get to study for 2 yrs.

Please make sure you understand the process for applying for PR before coming to Australia to study for 2 yrs.

I am repeating that you cannot simply apply for PR just because you have studied for 2 yrs. You need to fulfill other requirements such as applying for EOI and getting an invitation and then if you score the pass marks you apply for PR.

To meet this requirement, you must have completed in no less than 16 calendar months either:

a single qualification requiring at least two academic years study


more than one qualification resulting in a total period of at least two academic years study.

So basically you can do your 102 weeks course which is 2 yrs of 24months in minimum 16 calendar months and you will still be able to fulfill the 2 yr requirement.

That depends upon what your VET diploma is.

English language proficiency courses or enabling programs cannot be used to meet the Australian study requirement.

So is your second course an enabling program? If yes then No you cannot join the two.

In my case, I had done one year of undergraduate in Brisbane(equivalent to 8 units)and was awarded an accounting degree from The University of Queensland in December 2011. I came back to Malaysia for about 16 months. Then in July 2013, I went back to Australia to do an one-year master degree(8 units).
My question is with my current situation, can it be considered as two academic years of study?

You need to contact AIM and confirm with them what are the per-requisites for gaining a positive skills recognition for the profession of Engineering Manager 133211.

I dont think AIM gives a positive skills assessment just based on a degree.

Please check with AIM.

If you complete this degree in 16 months then you will only have met the 2 yr study criteria.

Not sure why you are asking about PR as this will only get you 5 points for Australian study requirement while applying for a permanent resident visa. It does not help in any other way.

And depending upon your assessing body you might get points for qualification as well. But you need to confirm this with someone.

My course was a dipolma and i completed it which is 52 weeks and i transferred to the masters of that same course but i got exceptions of 4 subjects, which for a full masters the totally weeks is 78, i got the dipolma and masters combined in 18 months which is 3 semesters, with the combination of both degrees can that count towards two years?

You can calculate the total duration of your combined study by using this formula. If the total duration is at least 92 weeks then yes you fulfill the 2 yr study requirement.

Now i want to apply for 2 yr MBA in australian uni with my wife as a dependent. what i am worried about is what will happen after i complete my MBA? Do i have to return back home or i can do PSW and apply for PR after that?? My friends who are doing Masters of information technology says they can do 1 yr of professional studies and they can apply for PR after they complete 2 ye of studies at uni. Two academic years study is defined as 92 weeks of registered study.

It is a measure of the amount of study you have completed rather than how long it took you to complete the study. The requirement that you complete two academic years study does not mean that you need to study full-time to meet the Australian study requirement.

You can take longer to complete those requirements if you so choose. That is, if you take 92 weeks to complete a course registered with CRICOS for only 78 weeks, that course will still only count for 78 weeks towards meeting the Australian study requirement.

If you fall short of the 92 weeks of study due to exemptions you have received, you have several options to meet the Australian study requirement. Options could include:

Have the university rescind the exemptions so you must now successfully complete these subjects to be awarded your qualification

Complete additional units that are at the same level as the exempted units (or higher) and which are accepted by the university as award units for the qualification, such as an elective unit.

Note: If the education provider specifies the units as 'Non-Award' units, then these units will not be able to count towards meeting the Australian study requirement. Also the additional units would need to be of sufficient registered CRICOS duration to take you to a total of 92 weeks of registered study.

Also note: The academic transcript should indicate that the elective is contributing towards the award of the degree for this unit to be counted towards meeting the Australian study requirement to ensure that there is no doubt about the electives being part of the award of the qualification

Complete an additional qualification that is closely related to the occupation you nominate on your General Skilled Migration application.

This additional qualification must be of sufficient CRICOS registered duration to make up for the exempted units from the students course(s).

Really Appreciate , the manner in which you have written the blog.

I have a very specific question, in regards to 2 years study requirement.

I did my Masters of Science (Computers and Information Science) in year 2005-2006

The Letter i Have Got from University says

"Rahul has been enrolled in their Program from 11/03/2005 and studied for 2 years."

"All Academic Requirements were Completed on 11/12/2006"

"The Award was conferred on 20/12/2006"

By this Language , do i complete 2 years ?.

All depends on two things

1) What was the official duration of the course you enrolled in as listed on CRICOS website.

2) How much time did you take to complete the course.

The duration listed on the university degree/letter does not have much legal value.

So check what is the duration of the degree as listed on CRICOS.

And how much time did you take to complete ( which I guess is 2 yrs as listed on the letter).

First of all bravo for all this great information.

I am currently enrolled in a MBA program at Murdoch university in Perth which is CROCOS registered for 104 weeks.

The confusion i have is that i am a transferring student from the same university in Dubai, as in i have completed 40% of my course in Dubai and I am due to Finnish the rest 60% from the Perth campus. Basically i will be completing 3 semesters (18 months including the summer and winter breaks) in Perth but i am enrolled in this course from 2012 onwards at Dubai campus. So i have taken less course every semester because on my COE they gave me 1 year extra visa, so thought of splitting the load. In short, I have done only 1 semester with full load, and that was only here in Perth.

My question is, will I be eligible for a Temporary Graduate visa (subclass 485) if I end up taking another semester (3+1) which will then make my study here in Australia for 2 years, in addition to 1.5 years I have completed in Dubai, and as for the CROCOS of my course is already 104 weeks.
Mainly, Do I have to stay in Australia for total of 2 years, even if I was not taking the full time study load and can i still apply for the graduate visa, if I plan to take another 2 electives from the same course, to extend my degree for another semester?

Finally, as per CROCOS I have fulfilled the 92 weeks for the course, now do I have to somehow extend my stay in Australia to complete the 2 years?

I am sorry this is so confusing for me, I hope you understand my question.

However, if you undertook some study overseas but nevertheless completed at least two academic years of study in no less than 16 calendar months while in Australia you can still meet the Australian study requirement.

Example 1: You would have completed two academic years study in Australia if you undertook a three year, six semester Bachelor degree in the following pattern:

semester 1 - outside Australia
semester 2 - in Australia
semester 3 - in Australia
semester 4 - in Australia

1) Engineers Australia do not issue assessments based on post graduate Masters level degrees.

2) Engineers Australia only assess based on undergraduate degrees.

What was your undergraduate degree in? Civil Engineering or something else?

If your undergraduate degree WAS NOT in Civil Engineering then Engineers Australia WILL NOT issues positive skills assessment.

You may wish to verify this info with Engineers Australia.

. or should i apply for sol quantity surveyor as my course is accredited by Australian Institute of Quantity Surveyors (AIQS). thanks in advance


If your course is accredited by AIQS then it is better to gain positive skills assessment in a profession that is assessed by AIQS instead of Engineers Australia.

First and second trimester (2014) I was enrolled full time (4 units each trimester). this year due to certain issues I had to enroll in 3 units in first trimest and 1 unit in second trimester. So basically I WILL complete my course ths year october. Thus period of stay had to be increased to 2 years. I want to know can I apply for my post study work visa in october after my completion or should I do another additional degree to be eligible for it. Hope I have not confused you. The formula for calculating your time period is as follows

T=L X C/U , where:

T= Duration for which the student studied the course
L= length of course on CRICOS
C = number of units completed by student, excluding exemptions
U = number of units which would be necessary to complete the studies

As your course is now for 104 weeks then please type in 104 in the formula above and also enter the number of weeks you actually studied the course for.

The end result must be greater than 92 weeks ( not 104 weeks).
