Points for PR

For most General Skilled Migration visas, your application will be assessed against a points test. You can claim points under a range of different factors. The maximum points that can be claimed in any one factor reflects how valuable those characteristics are in the Australian labour market or in assisting settlement.

What is the pass mark?

The pass mark is the total points you need to score to be eligible for a points–tested General Skilled Migration visa.

What happens if you don't meet the pass mark?


If you have applied for a Skilled – Independent (Migrant) visa (subclass 175) or a Skilled – Sponsored (Migrant) visa (subclass 176) and you score below the pass mark, but above the 'pool mark', your application will be held 'in the pool' for up to two (2) years after assessment.

If the pass mark is lowered at any time in that two (2) year period, and your score is equal to or higher than the new pass mark, your application will be processed further.

Rather than waiting in the pool, you could consider the following visa options if you do not meet the pass mark:

  1. If you score 100 points you may be eligible for a Skilled – Sponsored (Migrant) visa (subclass 176) or a Skilled – Regional Sponsored (Provisional) visa (subclass 475) visa.

What are the current pass and pool marks?

Hi. I think your blog is very helpful and very informative. My sister is going to UniSa for her Masters in Information and Communication management. This course is accredited by the ACS. However we are unsure of the points that this course will be granted. I wanted to know how do i find out if this course will get 60 points or 50 points? Or as a rule does all courses recognised by the ACS gets 60 points? Kindly help me.

For every degree which is assessed by ACS, you can visit the ACS website at www.acs.org.au -- > Individuals -- > Course Accreditation --> Select the university in which you are enrolled --> check if the course you are enrolled is listed and how many points are assigned to it.

If the course is not listed, it would be better to contact ACS.

No, Not all courses accredited by ACS are NOT assigned 60 marks.

You have to check what score does your degree carry.

Depending on the category you apply for PR, check whether you have the required points or not. If yes then you will get PR. If not, then you will not get PR.

There is no such thing as direct PR. I am not sure what you are talking about.

The time taken is variable and depends from case to case basis.

What is the profession listed on SOL/MODL which is CLOSELY RELATED to the degree you want to do, that you will nominate after completing your degree?

If the profession you chose is not listed on the SOL/MODL

OR

Your degree is not closely related to the profession your have nominated


than you cannot apply for PR as the basic requirement for PR is that you do a degree which is closely related to a profession listed on the SOL/MODL

Whether your degree is closely related to the profession you plan to nominate, is a question I am unable to answer.

I would recommend you contact a lawyer once you come to Sydney. If you see that the degree is not related to a profession on SOL/MODL, then you can always change your degree.

Back again with a query mate. Well i was reading this section of your blog, and found it very useful again like the other bit of information available on the blog. So i went to the site to calculate my points assuming that i have finished my 2 years of studies by a (1.5yrs degree and an additional 6months course completing the 2 year rule) but there i noticed that you have to have been working from the past 3 out of 4 years for you to get extra work-ex points, now that wont be applicable to me as i would have been studying for the past 2 yrs. So how does that work? and what if some one has 2yrs plus but less than 3 yrs of work ex fair? i mean does he get points for his workex then? you see i am falling 5 points short of 120, i see no other place where i can score more. One site calculated my score and gave me 125 normally and 140 when asked if i had any relatives ( i have a first cousin) in oz. So does that help? ( they are aussie nationals too). And do they hold any liability if they sign any documents or something?

Yes make sure the additional 4 subjects you take are closely related to the earlier degree you did and both the degree plus the additional subjects you took are closely related to a profession on the SOL/MODL.

I am not sure what you are talking about.

But depending upon the type of application you apply for, onshore or Offshore, you would need work experience. For offshore migration, work experience is necessary. For onshore migration, if you are a student who has studied for two years, work experience is not necessary but can get you extra points.

As you are most probably an international student, you only need to have 20 hours per week paid work experience for 12 months of the previous 24 months before applying.

Yes thats right. You either work for 4 years (For IT professionals ) OR 1 year (for engineers)

OR

you study in Australia for two years.

Studying for two years in Australia is the same as working for four years over seas.

If you are applying for onshore migration as an international student, you will only get points for Australian work experience you which you have had for 12 months in the past 24 months.

Yes that is what happens with every one. You have to get extra points by either getting 7 in all bands of IELTS OR other options....

OR

Apply for a graduate skilled visa which you get for 18 months and then get work experience and then again apply for PR. The trick is that you do get a job related to your profession for at least 12 months out of those 18 months.

OR


if your spouse (or de facto spouse) meets all the basic requirements above and is able to nominate an occupation from the SOL and have his/her qualifications assessed as suitable for his/her nominated occupation, then you will be able to claim 5 points on your joint application.

To be eligible for sponsorship,You must be related to your sponsor as one of the following:

* a non-dependent child – including an adoptive or step-child
* a parent – including adoptive or step–parent

* an aunt or uncle – including adoptive or step–aunt or uncle

So as you can see, cousins are not mentioned in the above list. However, if the mother or father of your cousin is a PR or citizen in Australia, then they can sponsor you and you can get extra points.

Well i guess i would have to go in for the graduate skilled visa as the prior international work ex would have bee nullified by then. Even though i have an 8 band in all the four sections i think i wont get any extra points besides the usual for my English skills. And i guess the sponsorship also wont work out as i only have cousin brothers there and none of their parents are there. So thats not gonna help much as u said. Well lets hope i get the skilled grad visa and manage to get those points from the work ex.

But Anyways thank you so much for the help, i will keep visiting this blog for further reference and to check out some new informative sections if any.

If you have 8 band in all modules of IELTS, then you get 25 points for that and easily make 120 points.

I am not sure why you are worrying then.

Had a couple of quick questions. Based on the calculator I would just make 120 points, breaking it down as follows:

60 points for your nominated occupation
30 points for your age
25 points for English language ability
5 points for Australian qualifications

1) I am calculating 60 points based on the 2 year Australian Masters course I will be studying at Uni Melbourne. I have NO experience in that field. Would that be sufficient to bag all 60 points without actual experience?
2)I took my IELTS earlier and scored 8.6 or there abouts because it was a requirement for the university application process. Would I need to take the IELTS again after my 2 yr course when I would be applying for PR?
3) I am calculating 5 points for Australian qualifications based on the fact that I am studying a 2 yr course at the Uni of Melbourne. Is that fine?

Depends what course you would be studying. If its a course worth 60 points or not. That you can check from your assessing body.

If your IELTS has expired on the date of application, then yes, you will have to give IELTS again and score a band 7 in all modules if IELTS to be able to claim 25 points . The exam can be either academic or general.

Yes regardless of what course you study, 60 points or 50 point, you will get 5 points for simply for Australian qualification.

Please check the SOL and MODL and chose a occupation which is CLOSELY RELATED to the degree you plan to undertake in Australia.

Send me the conditions as listed on your visa.

Check your visa and it would have conditions such as 8054 etc listed on them.

The best would be to get band 7 in all modules of IELTS.

Remember, you can achieve that in either academic or general IELTS test.

But the IELTS is valid only for 2 years. So you will have to give it again in Australia.

Other then that you can get bonus points by

1. Working in your own profession listed on SOL for 900 hours while in Australia.

2. Working for 900 hours in any profession listed on MODL whether related to your profession or not.

You have said that your profession is on MODL. I am aware that certain IT professions are on MODL, however, to claim points for a profession on MODL, you have to have 1 yr of experience in that field.

After you complete your studies, you can apply for a graduate skilled visa, which allows you to stay in Australia for 18 months and work. You can then find a job in IT and apply for PR based on that work experience. But that would happen only if you have a job in IT in those 18 months. You can also include any work experience prior to those 18 months.

Yes plus getting 7 band in all modules will also solve the problem.

You can only claim points for the following relatives.

For an Australian resident/citizen to sponsor a skilled worker, the sponsor must be at least 18 years of age and usually resident in Australia as one of the following:

an Australian citizen
an Australian permanent resident
an Eligible New Zealand citizen.


The main applicant, applicants spouse or applicants interdependent partner must be related to the sponsor as one of the following:

1. A non-dependent child – including an adoptive or step-child

4.A niece or nephew – including adoptive or step–niece or nephew

Q.Where can a sponsor be living?

From your visa conditions, I dont see any restrictions.

What is your visa type?

Please let me know what is your visa type/the visa number.

If you have a normal 573 visa then there is no issue.

If your visa class and visa conditions do not imporse any restrictions, then its between you and your sponsor.

The immigration department has got nothing to do with it and cannot impose any restrictions on you to pay back to your sponsor.

If you are an international student in Australia and want to apply for immigration, you will be applying for visa subclass 885.

485 is just a graduate skilled visa for international students.

Mostly those people who are unable to meet the PR points apply for 485 so that they can get a job and then claim points for it.

I met this agent who told me that I need not to do Masters in order to get PR I can probably do without it. He made this evaluation for me:
1. BSc Hons Degree in Computer Science entitles me to 75 points(60 for degree and 15 for MODL)
2. Age 30 points
3. 15 points for IELTS
That makes a total of 120 points.
My concern here is that I only have 2 years of working in total (of development work in c# and java) after graduation.
So, am I eligible to claim these 15 points of MODL as claimed by that agent?

Q. Can you get PR without studying for two years in Australia.

Ans: Yes you can. Check the requirements of offshore immigration.

Q. Can an IT professional with two years of experience gain PR in Australia.

Ans: No. The ACS guidelines for a positive skills assessment require, people from other countries to have 4 years of paid work experience AND a bachelors degree in computer science. Only then you can get a positive skills assessment.

BUT

If you think you can get a positive skills assessment from ACS by having two years of work experience, then go for it. You never know, lady luck might be on your side. So give it a try and try to get a positive skills assessment from ACS.

If you can get that, then getting PR is a piece of cake as the immigration department only needs 1 year of experience. The issue is only ACS. And without ACS, the immigration department wont consider you.

Q. Can I claim bonus points for my profession being on MODL.

Ans: Yes you can claim bonus points ONLY if you have worked in that field for 1 year. If you were a J2EEE developer working for 2 years in the industry and the IT profession on MODL is Oracle professional, then you CANNOT claim points for that. Unless you can fool the ACS people into giving you a positive skills assessment for being an Oracel professional.

So it all boils down to the point whether you can convince the ACS or not.

So in order to gain points for IT profession, you first have to get a positive skills assessment from ACS.

In order to claim bonus points for an IT related profession, you have to convince ACS that you have worked in A,B,C for 1 year etc.

Hope this answers your question.

Last of all your consultant is wrong.

You dont get 60 points for your degree. You get 60 points for being a professional whose profession is listed on the SOL/MODL.

The degree requirement is a pre-requisite.

Without degree you do not fulfill the basic criteria and cannot apply.

You can apply if your points are less BUT you cannot apply if you dont fulfill the basic requirements.

I have one little question about the Permanent visa 885. I should be getting 110 points when I complete my degree in December (assuming that I will get 7/10 for all the English tests) so I am missing 10 points to go for the visa 885.

But on the DIMA site it says you can get 10 points for Australian Work Experience.

Quoting the DIMA site :
"You are eligible to be awarded Australian work experience points if you have been employed in Australia:
in an occupation listed on the Skilled Occupation List (SOL)
while holding a visa that allows you to work
for at least 20 hours a week
in a paid position

I am working part-time (20 hrs a week)as a Medical Lab Assistant. But the job is not related to my degree (Chemistry) at all, but it is closely related to a job in the SOL but not the MODL ( Medical Laboratory Technical Officer). So would that give me the extra 10 points if I have been in that job for more than 1 year evenif it's not related to my chemistry degree? Or does the job has to be related to my degree to get the extra 10 points?

Yes that is what I also said. If the profession you have worked in while in Australia is on the SOL, then you should nominate the same profession while applying for PR.

Who decides whether the profession you have worked in is in fact closely related to the one listed on the SOL?

Ans: The assessing body. It is the assessing body which will let the immigration department know that Mr. A worked in profession B and he qualifies as a professional in profession B and that his work experience for one year makes him a professional in profession B.

Your degree is related to profession A. You worked in profession B.

Both A and B are listed on SOL. So instead of nominating Profession A for PR which is related to your degree, nominate profession B for PR in which you worked for 1 yr.


Because if you will chose profession A, you will run short of points.


Basically if you read the law, you will see that two years study rule is a pre-requisite. It doesnt fetch you any points. Without studying two yrs you cannot lodge an application. But without work experience you can lodge an application.



The law doesn't state that the degree you studied in for two years HAS TO BE relevant to the profession on the SOL you have worked in OR the profession you nominated for PR.

The law only requires you to have studied in Australia for two years.

You should double check this information with a registered Migration lawyer to confirm what I am saying. Let me know if you want to contact one. I might be able to get a free answer from him online through email. But if you want to have a sitting, that will cost money.

Last of all before nominating any profession, make sure that you get a positive skills assessment from your assessing body.

If your assessing body doesn't give you a positive skills assessment for the profession on the SOL which you want to nominate for PR then you are in trouble.

Who can be a sponsor?

To sponsor a skilled worker you must be at least 18 years of age and usually resident in Australia as one of the following:

* an Australian citizen
* an Australian permanent resident

You, your spouse or your interdependent partner must be related to your sponsor as one of the following:

* a non-dependent child – including an adoptive or step-child

Normally, when you lodge an application for a visa, you are placed on a bridging visa. The bridging visa is applicable from the day your previous visa expires.

So if your 485 expires after 10 days, and you apply for a new visa today, the bridging visa will take affect after 10 days.

The bridging visa is an indefinite visa which remains valid until the decision about your application is made.

You can actually get additional bonus points for having completed one of the following conditions

You get 15 points if

You have undertaken study for a period totalling at least three (3) years, during which you:

* met the requirements for award of a masters degree by an Australian educational institution as a result of course study:

o of at least one (1) year

* met the requirements for award of an undergraduate degree by an Australian educational institution as a result of course study:

o undertaken while you were present in Australia.

Since you would be only enrolling in a diploma, the above mentioned condition doesn't apply to you.

* met the requirements for award of an honours degree (second class (division 1) level or above) by an Australian educational institution as a result of course study:

I am not sure but after completing your bachelors degree, if you can study a little bit more and achieve a honours degree, you will get additional 15 bonus points.

Please note that, you have to choose a profession on the SOL after your complete your studies. The profession you choose MUST BE CLOSELY related to the degree(S) you have done.


If you think the above condition doesnt apply to you then have a look at the last condition which you can avail.

You get additional 15 points if

You have met the requirements for award of an undergraduate degree with honours (second class (division 1) level or above) by an Australian educational institution as a result of course study:

* of at least three (3) years
* undertaken while you were present in Australia.

The last condition only gets you 5 points which is when you have met the two (2) year study requirement.


So although you fulfil the two yr study requirement, BUT, it would be good to try to get an honours degree and get additional 15 points as you are going to study an additional yr in any case.


Please note that all the above information depends on the fact whether your degree(s) are closely related to a profession on the SOL or not?

Also remember that the immigration department might raise an objection if you have done multiple degrees and they do not match with each other.

Qualifications must be closely related to nominated occupation

The Australian qualification/s you have completed must be closely related to your nominated skilled occupation. This means that the subject matter and the skills gained from your qualifications can be applied at the level you achieved them in your nominated skilled occupation.

Examples:

* Diploma in Business and Certificate IV in Carpentry would be consistent with nominating Carpenter as your occupation as applicants could find those qualifications genuinely useful in operating their own business as a carpenter.

* Masters in IT and Certificate III in Carpentry would not be consistent with nominating Carpenter as your occupation as you have attained skills at a significantly higher level in a professional field and skills at that level will not have any practical application in working as a carpenter.


So if you do a diploma in secondary education while your degree is in Physics, that might be a problem for you as both the fields are not related. One field is related to teaching while the other field is related to Physics.

So as an advice, it would be better from a PR points of view to simple do an honours degree in Physics and then apply for PR.

I am assuming that there is a profession closely related to Physics degree on the SOL.

I am actually unaware of your answer.

There is some sort of a glitch in this.

As far as I know you can apply for 885 if you have a 485 graduate skilled visa.

But you need to check that with a lawyer.

The 485 visa allows overseas students who do not meet the criteria for a permanent General Skilled Migration visa to remain in Australia for 18 months to gain skilled work experience or improve their English language skills.

As a holder of this visa, you may apply for permanent residence at any time if you are able to meet the passmark on the General Skilled Migration points test.

It says that you can apply for PR if you have 485, but would be good to check with a lawyer.

If your IELTS result is valid on the date of lodgement of your visa, then you do not need to appear in another IELTS exam.

However, if you the IELTS exam has expired on the date of lodging the application then you need to appear in another exam.

All you need as a proof of job in your own profession is the following

1. Pay Slips showing you have worked 20 hours per week for 52 weeks, in the profession closely related to your degree and the profession you have nominated on the SOL.

2. Tax returns showing that you lodged a tax return on a salary earned from the job you are claiming points for.

3. Appointment letter stating job description and your job title.


4. I would recommend www.auslead.com as my choice of lawyer. He sits in Sydney but does cases from all around the world.

Why whats so hard about getting pay slips and group certificates?

Any way, yes just a postal receipt for assessment of degree would do and you can submit the police certificate later on.

I am not much sure about temporary visa, but if you have studied for two years you can apply for graduate skilled visa which is for 18 months and then apply for PR based on your work experience in the pharmacy you are working in.

1. The amount of time taken for a case office is not fixed but normally it happens within 6 months.

2. If the IELTS is valid on the date of your lodging the visa, then its ok. However, if the IELTS has expired on the date of lodging the visa, then you need to appear in the IELTS exam again.

No you dont need to do all tests again. Only IELTS again.

From now on, you must have received your IELTS results before you lodge the application. So without IELTS results, you cannot apply for PR.

So as a brother, you can support your brother.

The law above doesnt specifically mentioned credit cards.

I am unable to give you a clear YES or NO answer but since credit cards are also a form of a loan, I would say that yes they are acceptable source of income.

However, from my previous experience, the department favors cash, e.g. account etc since not every credit card allows you to take cash out.

But it would be good to contact the department and ask them directly.

I am working on my Aussie case through an agent and I received my +ve assessment from ACS stating:
"For the purpose of your your application you have as of November 2006 satisfied the requirements of the ACS PIM 2, Group A"
The confusion arises with the mention of November 2006 whereas I applied just a couple of months back....I guess they have missed out a ',' which have solved the confusion.
Anyways can you tell me the implication of the date in past ?
Also i have been assigned ASCO Code: 2231-15, my question here is that although I have been working part time(hours enough to be considered for full time) for period 07/01 - 07/08 (7 years as accepted by ACS), I also happened to complete my BCS within the same frame.
I supported my studies with the job...question is that I have been added into group A, so will the 4 years degree have any chances of spoiling my work experience in any way when applying to DIMIA for visa...
I can provide all the letters to them...thanks in advance

I have got a question which might be a bit out of context in terms it is going to fall in Study in Australia Blog....
I am posting nevertheless as I see you are generous enough to answer such ones :D
I am working on my Aussie case through an agent and I received my +ve assessment from ACS stating:
"For the purpose of your your application you have as of November 2006 satisfied the requirements of the ACS PIM 2, Group A"
The confusion arises with the mention of November 2006 whereas I applied just a couple of months back....I guess they have missed out a ',' which have solved the confusion.
Anyways can you tell me the implication of the date in past ?
Also i have been assigned ASCO Code: 2231-15, my question here is that although I have been working part time(hours enough to be considered for full time) for period 07/01 - 07/08 (7 years as accepted by ACS), I also happened to complete my BCS within the same frame.
I supported my studies with the job...question is that I have been added into group A, so will the 4 years degree have any chances of spoiling my work experience in any way when applying to DIMIA for visa...
I can provide all the letters to them...thanks in advance

You will see that this document was authored in 2006. PIM 2 Issue 8, 3 July 2006.

So you have been assessed in accordance with the current policies of ACS.

This is just a way of writing things. Nothing fancy about it.

Ans 2. No, your studies and your work have no conflict and there will be no problem as far as immigration is concerned.

Since ACS has already verified your work experience and degree, the immigration department would be happy that they have less work to do.

How can a bachelor degree just be of one and a half yr?

Any way, yes, when you are going to lodge your application for permanent residency, you will have to appear in the IELT test once again.

Since your occupation is nurse, your assessing body requires that you have a minimum of band 7 in all modules of an academic IELTS test.

So you will have to score 7 once again in all modules before lodging your PR application and getting yourself assessed from the assessing body of NURSES, Australian Nursing and Midwifery Council, ANMC, www.anmc.org.au

Hi! Thanks for all the information you gave us in your blog. I would like to seek for your advice though.

I'm 24 and I have completed a bachelor degree of graphic design in perth, australia. However I was only there for a year as i was a transferred student from a uni in Malaysia. Now im thinking of studying a master degree in business (marketing) to get pr. I'm aware that the new regulation to apply pr is to meet 2 year study requirement and if i took different courses to add up to 2 years, the courses must be closely related. My question is whether marketing and design will be seen as closely related? will you advice me to go for this course or perhaps its not a safe decision?

And if my master degree only takes 1.5 years to finish, will i be granted 15 point for having a degree in master? or it must be a total of 3 years of study? (2 years results in master degree and 1 year in bachelor, according to point calculator)

Hopefully you can help clearing up my confusion. Thanks a lot.

Before I can give you an answer, I need to know the following

1. What was the degree, you enrolled in? What is the course code? The degree that you did as a transfer student, was that registered on the CRICOS website?

Check the CRICOS website and check whether the course you attended was registered or not

2. Where did you finally complete the degree. In Malaysia or Australia?

3. Now, depending upon whether the first year you studied adds up with the second yr you want to study in Australia, you might or might not be able to apply for PR. Its a tricky question and I need to discuss this with my boss.

4. Yes graphic design and marketing and design are closely related. You can do both the courses.

5.If your masters degree is of 1.5 yrs then

i) You can apply for PR provided your earlier education is considered towards the two yr study period.

ii) In case your earlier education is not counted towards the 2 year rule then you cannot apply for PR as you would have only studied for 1.5 yrs. You would then need to study for another 6 months to fulfill the requirement of two yr study.

You do not get points for doing a degree. You get points for selecting a profession on the SOL. Please check the SOL and see what profession best suits your skills. Once you choose a profession, then you would have to obtain a positive skills assessment in that profession.

If you cannot obtain a positive skills assessment then you cannot apply for PR using that profession.


I would suggest that you apply for offshore immigration if you have at least one yr of work experience and can obtain a positive skill assessment in graphic design or a related profession. Please see the SOL and let me know what best suits your skills.

I want to apply for the PR but I have several questions before I do:

1. I studied in an exchange program for 1 year and then those subjects were credited towards my Bachelor in Business IS for which I was two years but not exactly fulltime because in total I took 14 subjects in the australian university.

2. I have one year Australian experience in my occupation, is that going to give me extra points?

3. I would really like to apply for the 885 but I don't have the enough money for it. Can I apply for the 485 and then just apply for the 885 once i get money? Is there any drawbacks of doing it this way. Are all the documents going to be still valid and my skills assessment as well?

4. Should I apply for the PR skills assessment instead of the recent graduate one? I can provide evidence of my australian experience.

5. Could you tell me what are the main differences of the 485 and the 885?

From what you have mentioned, I gather that you studied in Australia for only one yr.

If that is correct, then, you cannot apply for 885 since the requirement of 885 is that you should have studied in Australia for two yrs, full time in a CRICOS certified course.

Your next question is that you want to apply for 485. The requirement of 485 is once again that you should have studied in Australia for 2 yrs. If you have not studied in Australia for 2 yrs full time, then you cannot apply for 485.

Your next question is whether you can claim points for your Australian work experience.

Yes, you can if you have been employed in your nominated occupation for at least 1 yr in the past 4 yrs immediately before lodging the application.

Yes you can apply for 485, keep working in the profession you would like to nominate in the future and then when your 485 is about to expire, you lodge application for 885.

The draw back of doing it this way is that you end up spending more time and more money too! As you would have to process two applications 485 and then 885.

485 is a temporary 18 months work visa where as 885 is a permanent visa.


If you already have one yr of work experience in your profession then simply apply for 175 offshore immigration (provided you can get a positive skills assessment from your assessing body.)

However, that would mean that you will have to leave Australia once your current visa expires and wait to come back till your 175 application is approved.

You are confusing two different processes which are from two different organizations.

ACS is a different organization with its own requirements.

DIAC is a separate gov body with its own requirements.

ACS doesnt care what DIAC demands.

DIAC doesnt care what ACS demands.


ACS is not interested in how long you have studied as long as you have studied in a course accredited by them.

DIAC is only interested in a letter from ACS saying "Fernando is a qualified profession in ASCO Code XXXX-XX"

Now coming to your questions


I'm really concerned because my visa expires on 30 of Jan 09 and I thought I was going to be able to get the 485.


You can check the immigration department website which clearly says what 485 is. "An 18 month temporary visa for overseas students who have obtained an Australian qualification in Australia as a result of at least two (2) years study."


If you have not studied for two yrs in Australia, full time in a CRICOS course(s) and completed the course(s) as well, then you cannot apply for 485.

You are saying that it won't be possible for me to get it.

According to the rules, you need to have studied for two yrs and satisfied all conditions to be eligible for a 485.


So at the same time I have 1 year australian experience in my field but for the skills assessment (ACS) should I nominate myself as a recent graduate or with another occupation?

For getting an assessment from ACS, you need to nominate yourself as a recent graduate from an Australian university. That way you wont have to show 4 yrs of experience to be able to obtain an assessment from ACS and at the same time fulfill the one yr work experience requirement of DIAC as well.

Please note that the work experience you have and the profession you chose on the SOL, all MUST BE CLOSELY RELATED to each other. If you obtain an assessment from ACS for profession A but then select profession B on the SOL, it would be of no use then.

If one of them is not closely related, your application stands a chance of being rejected.

Yes thats why I advised you to apply in group C.

Your best chance is offshore immigration visa 175. I am assuming you have calculated your points and you are scoring 120 in the points test.

Well that would be a waste of money and time. If you have not studied for two yrs, your application will get rejected. You can give that extra cash to me :)


The only problem with 175 would be that upon the expiry of your current student visa, you will have to leave Australia. If you dont want to do that then enroll in another cheap course and extend your visa until your 175 is decided.

Do they refuse it straight away or do they give you the bridging visa before refusing it?

The 485 costs only $200, and they'll give me a bridging visa so do you think I should try and in the meantime save for a cheap course? Or do you know (maybe not the right place for this question) what kind of cheap course will give me a visa?

I'm desperate because my gf and I were thinking(defacto) of applying toegether for it. She has a visa with more time.So that means they gonna separate us for this amount of time? it sucks....

Well if your gf already has a visa, then you can apply for a dependent visa using her the primary applicant.

Now I am not entirely sure of this as I dont deal with such cases. You need to contact my boss for this.

Contact him after Christmas.

He will figure out a way for you that you dont have to leave Australia.

In case you get a dependent visa, then you can work full time and make money for your 175.

I am not sure if the 485 will be rejected right away or not.

Which city are you in? Sydney or Melbourne?

If you are in Sydney it would be worthwhile to have a session with my boss. He charges $110.

Or else you can send me all your documents scanned and I will get an answer for you.

If your uncle is an eligible New Zealand citizen, then you can apply for 886 or 176 visa which has a pool mark of 100.

An eligible New Zeland citizen is defined as


eligible New Zealand citizen

means a New Zealand citizen who:

(a) at the time of his or her last entry to Australia, would have satisfied public interest criteria 4001 to 4004 and 4007 to 4009; and

(b) either:

(i) was in Australia on 26 February 2001 as the holder of a Subclass 444 (Special Category) visa that was in force on that date; or

(ii) was in Australia as the holder of a Subclass 444 visa for a period of, or periods that total, not less than 1 year in the period of 2 years immediately before 26 February 2001; or

(iii) has a certificate, issued under the Social Security Act 1991, that states that the citizen was, for the purposes of that Act, residing in Australia on a particular date.

Ans 2: This is completely false. If you have the skills and experience, you will have a very good career.


PS: Please note that before you can apply for offshore immigration as an IT professional, you would need a positive skills assessment from ACS.

ACS requires that either you should have an Australian university degree OR 4 yrs of work experience in order to gain positive skills assessment.

If you do not have 4 yrs of work experience then ACS will not give you a positive skills assessment and hence the immigration department will not accept you as an IT professional.

Without a 4 yr bachelor degree in computer science, ACS will not even consider your application.

The pre-requisites set by ACS for applicants who do not have Australian qualifications are

1. A 4 yr bachelor degree in with majors in CS.

2. 4 yrs of work experience.


So you have two options

1. Get 4 yrs of work experience
2. Or study in Australia and get an Australian degree.

Yes if you live in Australia for 4 yrs out of which at least 1 yr as a permanent resident then you are eligible for citizenship.

By doing this one yr degree, provided it is listed as a professional course on the ACS website, you will be able to obtain a positive skills assessment from ACS. So yes then you would no longer need 4 yrs of work experience as required by ACS.

Well this course will help you over come the 4 yrs work experience issue for sure.

Now, if you want to apply for onshore immigration then you have to study for two yrs in Australia.

But if you want to save money, you can go back to your home country, apply for offshore immigration, obtain positive skills assessment from ACS based on your Australian qualifications and also obtain MODL points from ACS.

So that way you wont have to spent tuition fees for another yr.

So it depends whether you want to apply for onshore or offshore immigration.

The difference is in the requirements.

1. Onshore application requires that you study in Australia for two yrs.

2. Offshore requires that you have 4 yrs of work experience as an IT professional.


Normally onshore applications are processed quicker but this is not a hard and fast rule. Some times offshore applications are processed quickly.

If you can score 120 points, then it is easy to get PR whether onshore or offshore.

I am doing Masters in Clinical Psychology which has 60 points, if we get married is there a way to cover those missing points? Since we dont live together we cant apply for De Facto. If both of you are skilled in a profession which is on the SOL and both of you can obtain a positive skills assessment for the profession, then one of you who is most likely to score 120 points for 885 visa or 100 points for 886 visa should lodge the application as the primary applicant.

That way the primary applicant will get 5 points for spouse skills.

The primary applicant should be some one who can score at least 6 in IELTS and if the primary applicant can score 7 in IELTS, then that would be a bonus.

But I was thinking of a registered marriage.

Yes, since you dont live together, registered marriage would be the best option.

Please read the following to get an idea of the requirements for a spouse.

PS: The best thing should be that one of you who can score band 7 in all modules of IELTS and can also get a positive assessment from the relevant assessing body should lodge the application as the primary applicant.

Last time I checked the status and at that time files of 7 Aug were in progress. But from last 5-6 weeks I m not getting the status. I just want to know the progress status of offshore PR.

Wrong!

You need to study in a degree, diploma to fulfill the two yrs study requirement.

Studying in certificates is not counted towards the 2 yr rule.

That depends upon what profession you are selecting on the SOL. If you select a profession which has a requirement of 900 hours of work set by the assessing body, then you need to have that 900 hours of work requirement.

What exactly is Masters of Systems? What is the closely related profession on the SOL that matches masters of systems?

If this is some sort of an IT profession, then no, ACS doesnt impose any work requirements if you have an Australian Masters degree in IT.

How can a course be on the CSL? Only professions are on CSL. A university degree cannot be on CSL.

There are dozens of degrees which can enable you to get PR.

All you need to make sure is

1. You study in a degree/multiple degrees for a total period of 2 academic yrs or 92 weeks or more.

2. Your degree is closely related to the occupation you plan to nominate on the SOL. Check the SOL.

3. The degree you enroll in is a CRICOS certified.

4. If your assessing body is ACS, then check if the course is accredited by ACS.

5. Also check that you can score 120 points.

6. Most international students are able to score 110 points and run short of 10 points these days. So you need to score additional points by either scoring 7 or above in all modules of IELTS or claiming points for MODL. You can only claim points for MODL if you have work experience in your nominated occupation for at least 1 yr.

IT degrees accredited by ACS do not require work experience.

ACS will give you a positive skills assessment without work experience. You just need to complete the degree.

For example the degree of Internetworking from UTS doesnt require work experience. If you complete the degree, you can get a positive skills assessment from ACS without the need for 900 hours of work experience.

The 900 work requirement is for trade professions which are assessed by TRA like plumber, chef, hair dresser etc. ACS doesnt impose any work requirements for applicants with Australian postgraduate degrees.

Well a 2 yr masters degree will make you eligible for applying for onshore immigration visa subclass 885.

How many points are you scoring after doing this degree?

60 for occupation
30 for age
5 for australian qualifications
15 for IELTS

This brings the score to 110. What will you do about the rest of the 10 points?

Yes thats correct. You need to score 7 in all bands of IELTS to score 25 points. If you score less then 7 in any band you will not be able to claim 25 points.

I have explained to you several times that you do not need any work experience if you are doing an Australian Masters degree in IT being assessed by ACS.

You will only need work experience if you want to claim points for MODL.

Please do not ask the same question again and again.

Yes you can score extra points by clearing the exam for an interpreter or translator in one of Australia's 28 national languages and gain 5 points.

You can also claim extra points for spouse skills or regional study.

Yes your aunt (mother's sister) can sponsor you. You will get 5 points for your aunt being an Australian citizen.

Once you have completed two yrs of study, you should apply for 886 visa.

Courses are not PR courses.

You need to fulfill a series of requirements to be able to apply for PR. Simply studying a particular course doesnt mean you can apply for PR and get PR.

You need to fulfill the following main criteria to be able to apply for PR.

1. Study in a course closely related to a profession on the SOL.

2. Study for at least 92 academic weeks.

3. Study in a CRICOS certified course.

4. If you study multiple courses, all courses must be closely related to the profession you nominate on the SOL.

5. Last of all you also must fulfill the other criteria like English language requirements and scoring 120 points to get PR.

and how many pts i will get 4 dat course

You dont get points for studying a course.

You get points for nominating a profession.

For example after completing your degree you can nominate a 60 point profession and obtain a positive skills assessment from Australian computer society an IT professional.

How do you know how many points you are getting for your diploma? Was the diploma a two yr diploma?

If it was a two yr diploma, you can contact ACS and ask them if you can get a positive skills assessment for a profession on SOL based on your two yr diploma.

The course does not have any points. It is the profession on the SOL which you nominate that has points.

So you should be asking the question that whether you will get a positive skill assessment for a 60 point profession based on the degree you plan to do?

Now will your degree get you a positive skills assessment in a 60 point profession or not? That is some thing you need to check with ACS.

Only they can tell whether they will give you a positive skills assessment for a 60 point profession based on your degree or not.

Give them the name of the degree and the profession you plan to nominate and then ask whether they will give you a positive skills assessment in that profession or not.

so what i can understand from this is tht i cannot get assessed on my diplomas base..and if i do an undergrad degree then ill be eligible for assessment,,but still for how many points i dont know..

Yes you are right. Why can the ACS simply not tell you in a Yes or NO answer about the course when they already know what the course contents are and the course have been accredited by them.

Write a letter to them in proper English and tell them that the course has already been accredited by them and ACS knows what the contents are. So they should tell you what the outcome would be.

now, I wish to explain you my case, to see if I can get some orientation. I came to Australia on a student visa 10 months ago. Now, I have my skill assessed and meet all the basic requierements of Age, Occupation, English, and others. The situation is that I my experience of 3 out of the last 4 years has just expired, so I lost these 10 points. Now my points are 110.
I only have one month to apply, otherwise my recent work experience will be also expired. So, I will apply being concious of 110 points. then, I will attend to a new IELTS to obtain 25 points, instead of the 15 points I already have.

1st scenarium: Do you think, that I will be allowed to submit a higher ielts score in say, 2 months... so it gets there before the assessment, so I can reach 120 points?
I asked a migration agent and she said that I could do it, but im not 100% sure.

2nd scenarium:
If I my application goes to the pool, do I have to wait 2 years until the passmark is lower, or can I try to obtain extra points to rise my application (after being already in the pool). say, getting australian qualifications, or a better ielts, or australian work experience...

The first thing I need to know is whether you want to apply for 175 or 885 visa?

175 visa is an offshore visa which requires work experience.

885 visa is an onshore visa which requires two yr study in an Australian university.

There is a profession on the SOL named Community Worker 2512-13. You can contact VETASSESS and confirm if they will give you a positive skills assessment based on your Australian qualifications.

So its up to you if you want to complete the course or not. Remember that the profession is a 50 points profession. You need to score 120 points to get PR on a 885 visa. If the profession is on the list of a state then you can also apply for 886 visa which is a 100 points visa.

Yes you can apply for offshore immigration while being in Australia.

You need to prove your employment and the department normally expects tax returns and pay slips as evidence of work.

You can still lodge your tax. Go to a tax agent and lodge your tax.

Yes. You can apply for PR but you will need to leave Australia once your student visa finishes as you will not get a bridging visa.

You can apply for both offshore and onshore permanent residency.

For offshore migration you need to have a bachelors degree and at least one year of work experience in your relevant field in the PREVIOUS 12 MONTHS IMMEDIATELY BEFORE LODGING THE APPLICATION.

So make sure that on the day you lodge your offshore application visa subclass 175/176 (you can do it from inside Australia, just the visa class is different), your work experience is still valid1

For onshore migration, you need to have 2 years of Australian qualification in a profession closely related to your nominated profession.

So , once you complete your 2 years of education (which should be closely related to your nominated profession. Make sure that the second business diploma that you are doing is closely related to your nominated profession.), you obtain a positive skills assessment from engineers Australia and then apply for onshore immigration visa subclass 885 or 886.


And before you apply make sure you have enough points for the subclass you are applying.

The criteria for onshore immigration is as following

1) you should have studied for two academic yrs in Australia

2) you should have studied in a course which is closely related to a profession on the Skilled occupation list.

3) You should be able to obtain a positive skills assessment for the profession you want to nominate on the SOL. The skills assessment is issues by the respective skills assessing body.

4) You should have a minimum of 6 in all bands of IELTS.

5) You should lodge a valid application within 6 months of the release of your final results.

6) You should at least have the passing marks for the visa category you are applying for.


The process for Offshore immigration is as follows

You should at least have 1 yrs of work experience as per requirements of the immigration department.

You should have at least X yrs of work experience as per requirements of your assessing body.

You should have a positive skills assessment from your respective assessing body.

You should have at least a score of 6 in all bands of IELTS.

You should score the passing marks in the points test.

You should lodge a valid application.


Now what sort of immigration are you looking for.

The end result is the same. You get PR at the end of it. But the pathway and process is different for both. Which I explained earlier. One requires that you study in Australia for two yrs and the other requires that you have work experience before you apply.

The difference is in the requirements. As explained earlier.

In onshore version you have to study for two yrs. In offshore version you can apply from overseas.

Depends on your circumstances. Can you pay for two year education fees and expenses?

Check the Skilled occupation list and let me know what profession you are planning to nominate as the selected profession for Migration.

The assessing body of every profession has its own requirements. So once i know what profession you are going to nominate, only then I can further inform you.

I recently completed my Bachelor of Engineering Degree with second Class of Honours from The University of Technology, Sydney (UTS). UTS Student told me that there is neither division 1 nor 2 for Bacehelor of Engineering first class honours and second class of honours.

I am planning to apply for visa subclass 885. With my second class honours, will I be eligible for the 15 points "Bachelor Degree with Honours" instead of the 5 points "2 years-degree"??

What profession you plan to nominate after completing your Australian studies?

Lets say you want to nominate profession X, then check the assessing body for profession X. The assessing body for profession x would have its own rules and requirements for issuing a positive skills assessment.

So before you choose X,Y,z, check the rules and requirements of the assessing body.

There is no use studying for two years or nominating a profession if you cannot obtain a positive skills assessment.

please help me out that what course should i choose .... MBA ( accounts ) or MBA ( marketing ) ..... the occupations which in schedule 3 matches a little bit is managment accountant and business analyst .... i also checked Employer Nomination Scheme Occupation (esol) in that list there are some occupations matches directly that are , Marketing Specialist and Managment Comsultant .....

As I said, go and check the website of the assessing body, and see what are the requirements of the assessing body for issuing a positive skills assessment in that particular profession.

If you want to choose marketing manager, then you would go to AIM's website and see what rules they have for giving a positive skills assessment for a marketing manager.

I not very much aware of what a honors degree is and what is a division 1 degree.

You will have to check this with some one else.

Depends on whether you want to apply for offshore immigration or onshore immigration.

If you are applying for offshore immigration then you need to satisfy the criteria of two yr study in a field which is closely related to the profession you nominate on the SOL.

Also you need to obtain a positive skills assessment from your assessing body.

So to summarize

1. You need to study for two yrs in a course closely related to your nominated profession on SOL.

2. You need to obtain a positive skills assessment from your assessing body.

3. Score the pass marks.

4. Obtain the right score in IELTS.


The above is for on shore immigration.
